About half of Obamacare’s Consumer Operated and Oriented Plans, or co-ops, have imploded, leaving nearly half-a-million Americans looking for new health coverage.

And instead of addressing the problem, the Obama administration is pretending it doesn’t exist.

That’s the assessment of Rep. Adrian Smith, R-Neb., a member of the House Ways and Means Committee who recently wrote about the spate of failures in the Wall Street Journal.

“When it passed Congress in 2010, the Affordable Care Act offered substantial financial support to create nonprofit health-insurance plans. Today 11 of the 23 such regional Consumer Operated and Oriented Plans have failed – seven since the beginning of October,” Smith wrote.

“They’ve collapsed despite federal startup loans totaling more than $1.1 billion. These loans will likely never be fully repaid, while insurers and consumers will be on the hook for any unpaid claims left behind by failed insurers,” he added.

The congressman estimates 400,00-500,000 Americans lost their coverage in those 11 failed co-ops.

In an interview with Radio America, Smith says the co-ops were doomed from the start.

“I think they were improperly structured. They were allowed to charge too low a premium, not reflecting the actual costs. They thought the original subsidies – or loans if you will, but let’s face it, they’re subsidies, especially since they’re so unlikely to be repaid. That wasn’t enough,” said Smith, who is fuming more as he learns how these collapses transpired.

“The more I am learning about this entire situation, the more offensive it is, and this is just one part of Obamacare,” Smith said.

The congressman said what galls him most is that the government forced many people out of coverage they liked and then left those same people out in the cold.

“The thing that bothers me the most is when a good, upstanding citizen is doing everything they’re supposed to do to be a responsible individual,” Smith said. “Yet they are faced with canceled coverage, or they’re faced with a penalty for taking care of themselves.”

Adding to Smith’s frustrations is what he believes is utter indifference to the problem from the Obama administration.

“We had a hearing earlier this week, and the chief of staff from [the Centers of Medicare and Medicaid Services] was our witness,” Smith said. “[Dr. Mandy Cohen] sent the message that everything is just fine in the Obamacare co-op arena.”

He said it’s quite obvious that co-ops are not “just fine.”

“It’s not a win,” Smith said. “Nearly half of the co-ops have collapsed and that’s from New York to Nevada. Ours, with Nebraska and Iowa together, we were the first to collapse a year ago. Now we see them collapsing at a much quicker pace.”

How can the Department of Health and Human Services, or HHS, say all is well when almost half the co-ops have failed?

“In a very dismissive manner, I have to say, and it’s disappointing,” Smith said. “I started asking questions almost a year ago and HHS is not offering any answers.”

Not only is the government doing little to help, in some circumstances it is actually pushing co-ops to their deaths.

“The administrators of the Nebraska-Iowa plan saw a larger number of people sign up for their plan than they originally anticipated,” Smith said. “So they requested permission from HHS to suspend enrollment, to basically cap that at a number they figured was more manageable. They were prohibited by HHS from capping the number of enrollees.”

The congressman said that hastened the demise of the Nebraska-Iowa co-op. He said HHS did give permission for the Tennessee co-op to cap enrollment, but it collapsed anyway.

In the meantime, Smith is sponsoring legislation that would protect those who lost coverage with the failure of the co-ops from being fined by the IRS for not having coverage as mandated by federal law.

He believes all of Obamacare will eventually crater, but he hopes too many people aren’t hurt in the process.

“Ultimately, I think it collapses under its own weight,” he said. “I just want to do everything I can to minimize the damage in the ensuing time. That’s what weighs heavy on my mind is that the heavy hand of the federal government is actually hurting the very people Barack Obama was saying he was wanting to help.”

Last month, the New Mexico legislature unanimously passed a bipartisan bill essentially abolishing civil forfeiture in the Land of Enchantment (yes, that’s what they call themselves). But weeks went by and it looked like Gov. Susana Martinez was going to “pocket veto” the bill. If she hadn’t signed the bill by noon Tuesday, it would have expired and forfeiture reform would have been dead until next year.

But she signed it Tuesday at the eleventh hour (literally), making New Mexico the latest state to reform its asset forfeiture laws. Kudos to Gov.Martinez!

Civil asset forfeiture is a law enforcement tool enabling authorities to seize property permanently if the property is allegedly related to a crime. However, at the state and federal level numerous examples of abuse have come to light in recent years, and various states (and the District of Columbia) have ramped up due process protections for property owners.

The new law in New Mexico is comprehensive, but here are some highlights:

* A criminal conviction is required before property could be forfeited
* Provides additional due process protections to property owners, such as codifying an “innocent owner” presumption
* Places forfeiture proceeds in the general fund
* Requires additional reporting and transparency to allow better oversight of forfeiture process

As forfeiture reform continues to sweep the states and the federal government, New Mexico today stands as yet another example of bipartisan work getting things done. The next example might be Florida (join us for an event in Tallahassee next Monday!) or it might be your state.

In the closing days of the open enrollment period for the Affordable Care Act (ACA) , the U.S. Department of Health and Human Services (HHS) was mailing out letters notifying certain Americans that they had already started a healthcare coverage application on their behalf.

The HHS letter stated that the information they used to begin the application for individual Healthcare was obtain by the state agency in charge of implementing Obamacare.

The next step for the individual would be visit Healthcare.gov and complete the already started application to see if they qualify for “Marketplace coverage.”

News of the HHS letter was first mentioned by a listener of the popular “Daybreak with Drew Steele” Show on Fox 92.5, which is out of Fort Myers, Florida.

After his radio show concluded, another listener emailed Steele telling him about receiving the same letter. The listener asked for their identity to masked because they worked for the state of Florida.

Hi Drew,

I am not looking to have this read on air or my name used. I am merely wanting to have confirmation about another caller because I believe this is a pretty big story the STATE government is not talking about.

I listen every morning, but do not call in or contact you due to having a government position and I fear losing my job.

However, on Saturday of this past week I received a letter very similar to the letter I believe his name was Doug ( Doug called Wednesday A.M.) received from HHS.

It is a letter stating one of my dependents, I only have one, no longer qualifies for my insurance. I do not have said dependent on my insurance due to cost ($1000 a month).

This dependent is on Staywell Healthy Kids which is part of KidCare Florida (Staywell nor Kidcare has contacted me in regard to this matter). I do not receive subsidy due to my income but rather pay full premium for the coverage. The letter continued on to say that the State of Florida has forwarded my dependents information to them and they have set up an account for me. All I have to do is call to finish the process.

This scares me, badly. I will not finish the process as I have found coverage elsewhere, but it is a little freaky that this has happened.

A little freaky is right. The state of Florida is now passing personal information onto HHS, where they take the liberty of filling out an Obamacare health insurance application for you.

Is this how the Obama administration is inflating the enrollment numbers, by making it easier for people to finish the application?

You submitted an application for healthcare coverage, or made a change to your eligibility information. Your state sent your information in a secure transaction to the Health Insurance Marketplace, because you or someone on your application does not qualify for Medicaid or Children’s Health Insurance Plan (CHIP). You or someone on your application will likely be able to get coverage through the Marketplace, and get help paying for health coverage… We used the information from the state agency to start an application for you on Healthcare.gov. You’ll need to complete and submit this application to see if you qualify for Marketplace coverage.

To do this, you can log into your Healthcare.gov account, or if you don’t already have an account, you can create one on Healthcare.gov.

HHS urged enrollees to “confirm” information and “choose a plan before the deadline.”

An Ex-Sanford Police Chief Bill Lee tells CNN he was fired for not arresting Zimmerman. Bill Lee was pressured by city officials who didn’t care if Zimmerman was innocent, the city officials just wanted an arrest. Bill Lee told the officials you can’t arrest without probable cause, and was fired for upholding Zimmerman’s constitutional rights.

The George Zimmerman investigation was hijacked “in a number of ways” by outside forces, said the former police chief of Sanford, Florida.

Bill Lee, who testified Monday in Zimmerman’s second-degree murder trial, told CNN’s George Howell in an exclusive interview that he felt pressure from city officials to arrest Zimmerman to placate the public rather than as a matter of justice.

“It was (relayed) to me that they just wanted an arrest. They didn’t care if it got dismissed later,” he said. “You don’t do that.”

When Sanford police arrived on the scene on February 26, 2012, after Zimmerman fatally shot unarmed 17-year-old Trayvon Martin, they conducted a “sound” investigation, and the evidence provided no probable cause to arrest Zimmerman at the scene, he said.

It had nothing to do with Florida’s controversial “Stand Your Ground” law, he said; from an investigative standpoint, it was purely a matter of self-defense.

Zimmerman told police he killed Martin after the teen attacked him. While the evidence at the time corroborated that claim, the ex-chief said, Lee’s lead investigator made a recommendation that Zimmerman be charged with manslaughter.

It was a matter of protocol, Lee said. Arresting Zimmerman based on the evidence at hand would have been a violation of Zimmerman’s Fourth Amendment rights, he said. Thus, the Sanford police presented a “capias request” to the state’s attorney, asking that the prosecutor determine whether it was a “justifiable homicide,” issue a warrant for arrest or present the case to a grand jury.

“The police department needed to do a job, and there was some influence – outside influence and inside influence – that forced a change in the course of the normal criminal justice process,” Lee said. “With all the influence and the protests and petitions for an arrest, you still have to uphold you oath.”

The Judge attempts to force Zimmerman into a response after telling him he has a right not to respond (also refuses to allow Zimmerman’s lawyers to represent and answer for Zimmerman). A hostile exchange took place in the courtroom today where George Zimmerman is on trial for second degree murder as Judge Debra Nelson questioned the defendant about his plans to testify.

Nelson reminded Zimmerman that he has the “absolute right to remain silent” if he so desires and proceeded to ask him whether he was prepared to testify. Defense attorney Don West twice objected to the question, but was overruled by Nelson, who explained, “The court is entitled to inquire if Mr. Zimmerman’s determination [sic] as to whether or not he wants to testify.”

The judge then began asking Zimmerman how much time he requires to determine whether or not he would like to testify. West again objected to the question and asked for more time to speak with his client, prompting Judge Nelson to raise her voice and exclaim, “Your objection is overruled!”

The tension escalated as another of Zimmerman’s defense attorneys, Mark O’Mara, was overheard asking under his breath, “What is going on?”

Kathi Belich, a journalist following the trial for a local news channel, tweeted her surprise at the line of questioning, writing “I have never seen that in more than 30 years of court reporting.”
