Rep. Michael McCaul said Monday that the United States intelligence community has obtained specific evidence indicating that ISIS is targeting President Barack Obama’s Syrian refugee plan.

Speaking at the National Defense University on Monday, McCaul – the chairman of the House Homeland Security Committee – said that intelligence officials approached him “earlier this week” with the information.

“I don’t want to get into specifics to protect my sources,” McCaul explained, but “ISIS members in Syria have attempted to exploit it to get into the United States.”

“The U.S. government has information to indicate that individuals tied to terrorist groups in Syria have already attempted to gain access to our country through the U.S. refugee program,” yet the White House has not yet released this information to the public.

“To me that’s very disturbing.”

Additionally, McCaul called the intelligence officials’ decision to come forward “very courageous… given the political debate on the Hill,” which would indicate the information was not meant for his consumption.

President Obama has adamantly called upon the United States to open its doors to Syrian refugees. In his Thanksgiving address, he stated that, “nearly four centuries after the Mayflower set sail, the world is still full of pilgrims” seeking asylum in America.

The IRS did mishandle tea party and conservative groups’ nonprofit applications, but their behavior didn’t break any laws, the Justice Department said in a letter to Congress Friday that cleared the tax agency and former senior executive Lois G. Lerner of any crimes.

“Ineffective management is not a crime,” Assistant Attorney General Peter J. Kadzik said in a letter to the House Ways and Means Committee. “The Department of Justice’s exhaustive probe revealed no evidence that would support a criminal prosecution. What occurred is disquieting and may necessitate corrective action – but it does not warrant criminal prosecution.”

The decision comes more than two years after the IRS’s internal watchdog reported that auditors singled out tea party groups’ applications for special scrutiny and delayed those applications beyond reasonable timelines, preventing the groups from being able to say they were officially recognized nonprofits.

The agency initially admitted its bad behavior, and President Obama vowed an investigation – but he later said, in the middle of the probe, that there was no evidence of corruption.

Some Republicans have questioned the validity of the probe from the beginning, after learning that one of the Justice Department lawyers assigned to the investigation was a contributor to Mr. Obama’s political campaigns.

In its letter Friday the Justice Department specifically cleared Ms. Lerner, a senior executive in charge of approving the groups’ applications, who had authored a number of emails that suggested a bias against the tea party movement.

Investigators said none of the witnesses they interviewed believed Ms. Lerner acted out of political motives, and said that Ms. Lerner seemed to try to correct the inappropriate scrutiny once she “recognized that it was wrong.”

“In fact, Ms. Lerner was the first IRS official to recognize the magnitude of the problem and to take concerted steps to fix it,” Mr. Kadzik wrote.

IRS Commissioner John Koskinentestified before the House Oversight and Government Reform on March 26, 2014. Koskinen told Rep. Jason Chaffetz (R-UT) during the hearing that Lois Lerner’s emails were archived and it would take a long time to retrieve them.

In June 2014 the IRS told Congress Lois Lerner’s emails were lost in a computer crash.

In April the Inspector General notified the Senate Finance Committee that they have recovered thousands of Lois Lerner emails.

In June 2015 the Obama IRS erased 422 computer backup tapes related to the Tea Party scandal.

Earlier this month it was reported the Obama IRS plotted how they could prosecute conservative activist groups.

Judicial Watch released 906 pages of newly recovered Lois Lerner emails from the IRS that are believed to recently have been recovered by the IRS’ internal watchdog – the Treasury Inspector General for Tax Administration (TIGTA). The IRS released the emails under a court order by U.S. District Court Judge Emmet Sullivan. The new documents show that Lois Lerner and other top officials in the Exempt Organizations Unit of the Internal Revenue Service (IRS), including soon-to-be Acting IRS Commissioner Steve Miller, closely monitored and approved the controversial handling of tax-exempt applications by Tea Party organizations. The documents also show that at least one group received an inquiry from the IRS in order to buy time and keep the organization from contacting Congress.

At July 1, 2015, status conference, Judge Sullivan ordered the IRS to begin producing, every week, the nearly 1,800 newly recovered Lois Lerner emails responsive to Judicial Watch’s Freedom of Information Act (FOIA) request. Despite the court order, the IRS did not produce any Lois Lerner emails until July 15. The IRS also failed to provide Judicial Watch a status report of the Lois Lerner email production issues, as also ordered by Judge Sullivan. Last week, Judge Sullivan ordered sua sponte the parties to appear for a status hearing for tomorrow (July 29) shortly after Judicial Watch raised concerns about the IRS’ failure to comply with his orders to release the newly discovered Lerner emails and status updates on its production of previously “missing” documents.

The developments come in Judicial Watch’s FOIA lawsuit seeking documents about the Obama IRS’ targeting and harassment of Tea Party and conservative opponents of President Obama (Judicial Watch, Inc. v. Internal Revenue Service (No. 1:13-cv-01559)). Judicial Watch’s litigation forced the IRS first to admit that Lerner’s emails were supposedly missing and, then, that the emails were on IRS’ back-up systems.

Remember those horrifying police raids in Wisconsin a while back? With no hyperbole, it was modern-day tyranny that should have incensed the entire nation, regardless of political affiliation or viewpoint. Instead, very few ever even heard about it. Why? Because progressives were the perpetrators and conservatives were the targets. The raids were part of a so-called “investigation” of conservatives who were supporting Scott Walker.

Well new email evidence suggests that Lois Lerner may have been in cahoots with a Wisconsin official regarding the investigation.

Wisconsin’s campaign to investigate conservative tax-exempt groups has always seemed like an echo of the IRS’s scrutiny of conservative groups applying for tax-exempt status. It turns out that may be more than a coincidence.

Former IRS tax-exempt director Lois Lerner ran the agency’s policy on conservative groups. Kevin Kennedy runs the Wisconsin Government Accountability Board (GAB) that helped prosecutors with their secret John Doe investigation of conservative groups after the 2011 and 2012 recall elections of Governor Scott Walker and state senators.

Emails we’ve seen show that between 2011 and 2013 the two were in contact on multiple occasions, sharing articles on topics including greater donor disclosure and Wisconsin’s recall elections. The emails indicate the two were also personal friends who met for dinner and kept in professional touch. “Are you available for the 25th?” Ms. Lerner wrote in January 2012. “If so, perhaps we could work two nights in a row.”

This timing is significant because those were the years when the IRS increased its harassment of conservative groups and Wisconsin prosecutors gathered information that would lead to the John Doe probe that officially opened in September 2012. Ms. Lerner’s lawyer declined comment. Mr. Kennedy said via email that “Ms. Lerner is a professional friend who I have known for more than 20 years” but declined further comment.

For more than a year we have been asking a simple question:

“How can the DOJ conduct an investigation into unlawful aspects of the IRS targeting of specific 501(c)(4) groups, when the DOJ is the initiating body for the illegality they are seeking to investigate?” (June 28th, 2014)

A few days ago Judicial Watch revealed new FOIA discoveries and posed this:

“These new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” said Judicial Watch President Tom Fitton. “The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection.

And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information. How can the Justice Department and FBI investigate the very scandal in which they are implicated?” (link)

The entire scheme is riddled with complexity; almost too complex for the average person to understand, and seriously difficult to summarize. However, when you boil it down here’s the essential components that are no longer suspicion or supposition, but factually provable:

As a result of a trillion dollar stimulus filled with scheme and graft; and as a result of Obamacare being similarly schemed in backroom deals and late night votes; President Obama was “shellacked” in the November 2010 election.

The White House didn’t see the defeat a flawed policy issue; rather as the entrenched ideologues they are, they saw the SCOTUS case “citizens united” as the principle tool used by the White House opponents to organize and fund political movements, ie. the tea party.

The Obama Team response to the 2010 Shellacking was to use the Dept. of Justice (AG Eric Holder) to weaponize the IRS and go after groups -like Tea Party Groups- organized under the financial umbrella of 501(c)(4) donation structuring.

Years later, when the scheme was discovered – the White House denied knowledge (“not even a smidgen of corruption”), the DOJ feigned ignorance, and the IRS began working overtime trying to hide the construct of the prior communication, planning and strategy.


* The head of IRS tax exempt division, Louis Lerner, pled the Fifth.
* Obama’s Chief of Staff Jack Lew was made Treasury Secretary (IRS is sub division of Treasury Dept.) where he was/is able to continue hiding information.
* And Eric Holder constructed a team of DOJ lawyers to isolate, hide and manipulate the trail of evidence within the DOJ.

That’s the essence of what took place and where things stand.

Currently the court system is being used to try and penetrate the roadblocks put in place by all of the various agencies scrubbing emails, deleting hard drives, refusing to release public records, and working diligently to protect the White House.

Last April House Oversight Chairman Darrell Issa (R-CA) released a report implicating Democrat Rep. Elijah Cummings (D-MD) in colluding with the IRS and Lois Lerner against the nonpartisan voters rights group “True the Vote.”

Catherine Engelbrecht, the founder of “True the Vote,” testified before Congress in February. She was targeted by FBI, IRS, ATF, and OSHA after she filed for tax exempt status for her voters rights group.

Engelbrecht said this during her testimony before Congress and Cummings: “Frankly, to sit before my accuser and be silent in the face of what he did was unconscionable.”

This week the House Oversight Committee released more emails that prove the IRS was feeding Rep. Cummings with confidential tax information on the voter fraud prevention group True the Vote.

Townhall reported:

New IRS emails released by the House Oversight Committee show staff working for Democratic Ranking Member Elijah Cummings communicated with the IRS multiple times between 2012 and 2013 about voter fraud prevention group True the Vote. True the Vote was targeted by the IRS after applying for tax exempt status more than two years ago. Further, information shows the IRS and Cummings’ staff asked for nearly identical information from True the Vote President Catherine Engelbrecht about her organization, indicating coordination and improper sharing of confidential taxpayer information.

Chairman of the House Oversight Committee Darrell Issa, along with five Subcommittee Chairmen are demanding Cummings provide an explanation for the staff inquiries to the IRS about True the Vote and for his denial that his staff ever contacted the IRS about the group.

“Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials – which you did not disclose to Majority Members or staff – indicates otherwise,” the letter to Cummings states. “As the Committee is scheduled to consider a resolution holding Ms. Lerner, a participant in responding to your communications that you failed to disclose, in contempt of Congress, you have an obligation to fully explain your staff’s undisclosed contacts with the IRS.”

The IRS produced this e-mail on April 2, 2014 – only days after Oversight Committee Members had taken new IRS Commissioner John Koskinen to task for withholding relevant e-mails. The Chairman and five Subcommittee Chairmen on the Oversight Committee today sent a letter to Ranking Member Cummings demanding an explanation for his staff’s queries, why the Minority hid these efforts from the Majority, and why the Ranking Member denied such actions by his staff at a February Subcommittee hearing:

“Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials – which you did not disclose to Majority Members or staff – indicates otherwise,” wrote the Chairman and five Subcommittee Chairmen of the Oversight Committee. “As the Committee is scheduled to consider a resolution holding Ms. Lerner, a participant in responding to your communications that you failed to disclose, in contempt of Congress, you have an obligation to fully explain your staff’s undisclosed contacts with the IRS.”

The letter notes:

* The IRS and the Oversight Minority made numerous requests for virtually identical information from True the Vote, raising concerns that the IRS improperly shared protected taxpayer information with Rep. Cummings’ staff.

* Five days after Cummings contacted True the Vote seeking “copies of all training materials used for volunteers, affiliates, or other entities,” the IRS sent True the Vote a letter requesting True the Vote provide “a copy of [True the Vote’s] volunteer registration form,” “…the process you use to assign volunteers,” “how you keep your volunteers in teams,” and “how your volunteers are deployed… following the training they receive by you.”

* On or before January 25, 2013, Cummings’ staff requested more information from the IRS about True the Vote. The head of the IRS Legislative Affairs office e-mailed several IRS officials, including former Exempt Organizations Director Lois Lerner, that “House Oversight Committee Minority staff” sought information about True the Vote. On Monday, January 28, Lerner wrote to her deputy Holly Paz: “Did we find anything?” When Paz informed her minutes later that she had not heard back about True the Vote’s information, Lerner replied: “thanks – check tomorrow please.”

* On January 31, 2013, Paz attached True the Vote’s form 990s, which she authorized the IRS to share with the Minority staff. Neither Cummings nor the IRS shared these requested documents with the Oversight Majority. None of the Minority’s communications about True the Vote with the IRS were shared with the Committee Majority even though Ranking Member Cummings frequently complains about the Committee Majority contacting individuals on official matters without the involvement of Minority staff.

Cummings denied that his staff, “might have been involved in putting True the Vote on the radar screen of some of these Federal agencies” at a February 6, 2014, Subcommittee hearing:

We don’t know that, but we – we’re going to do everything we can do to try to get to the bottom of how did this all happen.

Mr. Cummings. I want to thank the gentleman for his courtesy. What she just said is absolutely incorrect and not true.

The Inspector General’s office charged with looking into the IRS targeting scandal has denied Freedom of Information Act (FOIA) requests filed by The Hill pertaining to more than 500 correspondences between their office (known as TIGTA) and various Obama officials and IRS scandal players. Correspondent Bob Cusack reports on the latest stonewall:

The Obama administration is refusing to publicly release more than 500 documents on the IRS’s targeting of Tea Party groups. Twenty months after the IRS scandal broke, there are still many unanswered questions about who was spearheading the agency’s scrutiny of conservative-leaning organizations. The Hill sought access to government documents that might provide a glimpse of the decision-making through a Freedom of Information Act (FOIA) request. The Hill asked for 2013 emails and other correspondence between the IRS and the Treasury Inspector General for Tax Administration (TIGTA). The request specifically sought emails from former IRS official Lois Lerner and Treasury officials, including Secretary Jack Lew, while the inspector general was working on its explosive May 2013 report that the IRS used “inappropriate criteria” to review the political activities of tax-exempt groups. TIGTA opted not to release any of the 512 documents covered by the request, citing various exemptions in the law. The Hill recently appealed the FOIA decision, but TIGTA denied the appeal. TIGTA also declined to comment for this article.

So in addition to the IRS “losing” and “accidentally” destroying certain communications attached to this scandal, the IG’s office is also blocking access to documents that do exist. I discussed these latest developments with AB Stoddard on Fox News earlier today:

Cusack’s story goes on to list the various reasons TIGTA cited in refusing to release any of the 512 documents:

In its written response to The Hill, TIGTA cited FOIA exemptions ranging from interagency communication to personal privacy. It also claimed it cannot release relevant documents “when interference with the law enforcement proceedings can be reasonably expected.” Yet, congressional Republicans say there is no evidence of any prosecution in the works, and media outlets have indicated that the Department of Justice and the FBI have already determined that no charges will be filed. Rep. Jim Jordan (R-Ohio) notes that eight months after Lerner was held in contempt of Congress for not testifying at two hearings, the matter has not yet been referred to a grand jury.

They point to “personal privacy” concerns. If only the IRS had been equally concerned about conservative groups’ privacy before leaking donor lists to hostile rival organizations. And if only the IRS were sufficiently committed to privacy that they did not hire back hundreds of employees fired for cause, including improper use of taxpayers’ private information. Alas, different rules. Another excuse given is the ‘reasonable expectation’ of impending criminal proceedings, of which there have been zero indications thus far. As I noted in the segment, one can’t help but wonder if there’s any connection between the lack of charges and the status of the leader of the DOJ’s investigation as an Obama and Democratic donor over multiple election cycles. On one hand, there are no signs of any criminal prosecutions coming down the pike. On the other, the possibility that they might someday materialize is being held up as a cause to deny transparency requests. Neat trick, that. If and when the administration is asked about any of this, they will undoubtedly return to their old playbook, directing reporters to the tens of thousands of documents they’ve released, like these:

Last week, Senate Finance Committee Chairman Orrin Hatch (R-Utah) said the IRS recently delivered 86,000 pages of new documents to the panel. Hatch added, “These documents… were given to us without notice or explanation roughly twenty months after we made our initial document request [on the targeting].”

You’re asking about a few hundred emails over here, but look over there at those tens of thousands of other emails we dumped without warning, nearly two years after they were requested! And of the document drop, who’s to say that the most relevant or damning emails weren’t deliberately excluded, as was the case in the Benghazi cover-up? I should point out that this lack of cooperation emanates from the Inspector General’s office, which is interesting, given the IG’s role as a pro-transparency watchdog. We don’t know nearly enough to impugn anyone’s motives within TIGTA at this point – recall that Democrats launched a shameful assault on the IG’s credibility when this scandal was a front-page story – but it’s not surprising that some Republicans are frustrated. And it’s not as if GOP lawmakers haven’t questioned TIGTA’s practices in the past: When the IRS scandal broke, it eventually became clear that the IG’s office and elements within the Obama administration knew of the agency’s abuse months prior to the 2012 election, but the scandal’s existence was successfully buried until the spring of 2013. Don’t forget, incidentally, that the White House’s official story on how any when they were made aware of the targeting practices shifted roughly half-a-dozen times before they finally settled on an answer. It also seems worthwhile to note that a separate Inspector General’s office came under withering criticism last year for a report on the VA scandal, the findings of which were reportedly watered down following political pressure from the Obama administration.

Black on white crime has been on an alarming rise over the last five months in St. Paul, Minnesota, and the mainstream media is ignoring these clearly racial attacks.

Even though black gangs have been assaulting whites in many cases since September, the media only just now ran a story about it, and it didn’t contain any hint of the racial aspect of the crimes. The only interview for the story was with a black man, who said he is now afraid to work downtown.

According to Conservative Tribune, the list of these crimes in St. Paul is staggering, and it’s growing.

One disturbing case involved a gang of fifty black thugs nearly beating a white woman to death at a St. Paul train station. They eventually left her unconscious and moved their brawl to a nearby hotel, where a wedding reception was taking place. The guests were so traumatized by what happened that they promised they’d never visit the city again.

Another case involved a black gang entering a restaurant full of white people. A black female then poured water on a white woman while a fellow gang member stole her phone.

In another case, six black thugs attacked two white men in an overhead walkway, leaving one of their victims with a broken wrist and the other seriously bruised.

Of course, the mainstream media and race baiters are staying mum about these assaults. You can count on them showing up as soon as a cop saves one of the white victims by shooting a black gang member.

Infernal Revenue Service Now Under Fire For Targeting Breitbart.com

The Internal Revenue Service, already under investigation for illegally targeting conservative and tea party groups, recently audited the conservative Breitbart News Network in a move that the company says was politically motivated.

The IRS sought the company’s financial records from 2012, Fox News reported earlier today. Brietbart.com relaunched that year with a more robust reporting team. Over the past two years, it has produced hard-hitting stories exposing scandals in the Obama administration.

The news drew a swift reaction from Breitbart’s leaders and prompted Sen. Ted Cruz, R-Texas, to fire off a letter to the IRS demanding answers about the audit.

“For the IRS to behave like a partisan political organization, targeting media organizations whose views differ from the president’s, would represent a gross abuse of power,” Cruz said. “It would undermine the statutory mission and integrity of the IRS. And it would likely subject IRS employees to criminal prosecution.”

Cruz said the IRS’ recent track record made the action against Breitbart “highly questionable.”

For more than a year, the agency has faced scrutiny for its illegal targeting of conservative and tea party groups seeking nonprofit status. The IRS also recently agreed to pay a $50,000 fine for wrongfully leaking the National Organization for Marriage’s confidential tax information.

Breitbart’s leaders said they wouldn’t cower under the threat of an IRS audit.

“We refuse to be intimidated by any efforts of the IRS to suppress our investigations of the Obama administration, including our ongoing effort to show the American people the fiasco that is our southern border,” said Stephen K. Bannon, executive chairman of Breitbart News Network, told The Daily Signal.

Added Larry Solov, president and CEO: “While we intend to comply fully with the audit, we will not stop our investigative reporting wherever it leads, including the White House.”

Fox News reported that the IRS “asked for a litany of documents, including logs of its receipts and expenses, but also its partnership agreement and a ‘written narrative’ of the business.” The agency told Fox News:

Federal privacy laws prohibit the IRS from commenting on specific taxpayer situations. The IRS stresses that audits are based on the information related to tax returns and the underlying tax law – nothing else. Audits are handled by career, non-partisan civil servants, and the IRS has safeguards in place to protect the exam process.

Cruz, in his letter to IRS Commissioner John Koskinen, appeared unmoved.

“This media audit, coupled with the recent proposal of 49 Senate Democrats to amend the Constitution to give Congress plenary power to regulate political speech, paints a disturbing picture of a coordinated assault on the First Amendment,” Cruz wrote.

Senate Democrats are currently debating a proposal that would amend the First Amendment by restricting political activity of Americans.

Cruz is also seeking the answers to these seven questions from the IRS:

1. How many other news organizations have been audited since President Obama has been in office?
2. How many of them could be identified as conservative- or liberal-leaning?
3. Have any other news organization been subjected to this sort of far-reaching and oppressive inquiry, including requesting the personal tax records of editors and reporters?
4. At what point does the IRS decide to take action to audit a news outlet?
5. Does the IRS worry that its extremely burdensome auditing process could effectively silence the press?
6. Previously, Sen. [Dick] Durbin wrote the IRS asking that it examine the tax-exempt status of Crossroads GPS, a Republican organization that spends money electing Republicans. Did the IRS ever receive any communications from any elected official asking it to examine Breitbart News Network, LLC?
7. Who, precisely, is responsible for making the decision to audit Breitbart News Network, LLC?

Lois Lerner’s missing emails are likely gone forever because the Internal Revenue Service destroyed the hard drive she used at the time tea party groups were targeted, according to sources on Capitol Hill.

“We’ve been informed that the hard drive has been thrown away,” Sen. Orrin Hatch, R-Utah, told Politico. Two other sources confirmed Hatch’s account.

The news brought a swift response from Darrell Issa, R-Calif., chairman of the House Committee On Oversight and Government Reform. In a statement late last night, Issa said:

If the IRS truly got rid of evidence in a way that violated the Federal Records Act and ensured the FBI never got a crack at recovering files from an official claiming a Fifth amendment protection against self-incrimination, this is proof their whole line about ‘losing’ emails in the targeting scandal was just one more attempted deception. Old and useless binders of information are still stored and maintained on federal agency shelves; official records, like the e-mails of a prominent official, don’t just disappear without a trace unless that was the intention.

The latest revelation sets the stage for what is expected to be a contentious hearing Friday when IRS Commissioner John Koskinen is scheduled to appear before the committee. In March, the commissioner assured the Oversight and Government Reform Committee the IRS would comply with the request to turn over the emails as congressional investigators probed Lerner’s involvement in the scandal.

As part of Issa’s latest subpoena, he asked the IRS to turn over “all hard drives, external drives, thumb drives and computers” and “all electronic communication devices the IRS issued to Lois G. Lerner.”

Lerner, who was held in contempt of Congress for her refusal to cooperate, was director of the IRS’ tax-exempt office at the time tea party groups faced delays and additional scrutiny in their applications to the IRS. Last week, the IRS revealed it had “lost” an email messages from a period between January 2009 through April 2011 because of a computer crash.

After a year of delays the Obama IRS says it lost Lois Lerner’s emails in a computer crash.

Today, Ways and Means Committee Chairman Dave Camp (R-MI) issued the following statement regarding the Internal Revenue Service informing the Committee that they have lost Lois Lerner emails from a period of January 2009 – April 2011. Due to a supposed computer crash, the agency only has Lerner emails to and from other IRS employees during this time frame. The IRS claims it cannot produce emails written only to or from Lerner and outside agencies or groups, such as the White House, Treasury, Department of Justice, FEC, or Democrat offices.

“The fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to Congressional inquiries. There needs to be an immediate investigation and forensic audit by Department of Justice as well as the Inspector General.

“Just a short time ago, Commissioner Koskinen promised to produce all Lerner documents. It appears now that was an empty promise. Frankly, these are the critical years of the targeting of conservative groups that could explain who knew what when, and what, if any, coordination there was between agencies. Instead, because of this loss of documents, we are conveniently left to believe that Lois Lerner acted alone. This failure of the IRS requires the White House, which promised to get to the bottom of this, to do an Administration-wide search and production of any emails to or from Lois Lerner. The Administration has repeatedly referred us back to the IRS for production of materials. It is clear that is wholly insufficient when it comes to determining the full scope of the violation of taxpayer rights.”

Veteran IT Professional Gives Six Reasons Why The IRS’ Claim That It ‘Lost’ Two Years Of Lois Lerner’s Emails Is ‘Simply Not Feasible’ – The Blaze

A veteran IT professional tells TheBlaze that the IRS’ claim that the agency lost two years’ worth of former IRS official Lois Lerner’s emails is “simply not feasible.”

On Friday, members of Congress revealed that the IRS would not be able to hand over Lerner’s emails to and from other IRS employees from January 2009 to April 2011, possibly due to a “glitch” or “crash.” Lawmakers were seeking the emails as part of their investigation into the IRS targeting scandal.

Norman Cillo, an Army veteran who worked in intelligence and a former program manager at Microsoft, argued it is very difficult to lose emails for good and laid out six reasons why he believes Congress is “being lied to” about the Lerner emails:

1. I believe the government uses Microsoft Exchange for their email servers. They have built-in exchange mail database redundancy. So, unless they did not follow Microsofts recommendations they are telling a falsehood. You can see by the diagram below that if you have three servers in a DAG you have three copies of the database.

2. Every IT organization that I know of has hotswappable disk drives. Every server built since 2000 has them. Meaning that if a single disk goes bad it’s easy to replace.

3. ALL Servers use some form of RAID technology. The only way that data can be totally lost (Meaning difficult to bring back) is if more than a single disk goes before the first bad disk is replaced. In the diagram below you can see that its possible to lose a single disk and still keep the data.

4. If the server crashed (Hardware failure other than disks), then the disks that contain the DATA for the Exchange database is still available because the server hardware and disks are exchangeable. Meaning that if I have another server with the same hardware in it, I can put the disks in and everything should boot right up.

5. All email servers in a professional organization use TAPE backup. Meaning if all the above fails, you can restore the server using the TAPE backups.

6. If they are talking about her local PC, then it’s a simple matter of going to the servers which have the email and getting them from the servers. If the servers have removed the data you can still get them by using the backups of the servers to recover the emails.

However, Cillo, who has been working in IT for roughly 16 years and is currently a consultant for a tech company, said it’s possible the IRS is telling the truth if the federal agency is “totally mismanaged and has the worst IT department ever.”

Other than that, it’s just not “feasible,” he told TheBlaze. “If the IRS’ email server is in such a state that they only have one copy of data and the server crashes and it’s gone, I’ve never heard of such a thing.”

“I don’t know of any email administrator that doesn’t have at least three ways of getting that mail back,” he added. “It’s either on the disks or it’s on a TAPE backup someplace or in an archive server. There are at least three ways the government can get those emails.”

Congress Abetted The IRS Targeting Of Conservatives – Wall Street Journal

On Monday the Center for Competitive Politics filed a complaint with the Senate Select Committee on Ethics against nine U.S. senators: for interfering with IRS tax proceedings; for misusing official resources for campaign purposes; and for improper conduct that reflects poorly upon the Senate. Attempting to use the IRS to advance a partisan, electoral agenda is a fundamental assault on good government. We believe these elected officials have staged such an assault.

The complaint documents how the senators improperly interfered with IRS adjudications to further their party’s electoral prospects. They pressured the IRS to undertake income-tax investigations of specific organizations, to find that specific organizations were in violation of the law, to reach predetermined results pertaining to pending applications by individual organizations for nonprofit status, and to adopt specific regulatory interpretations and policies to further their campaign goals.

A year ago in May it became public knowledge that the IRS had improperly targeted conservative organizations. Republicans have since attempted to find a “smoking gun” directly linking the scandal to the White House. That likely does not exist, because that’s not the way these things are done. Meanwhile, their quest has helped enable the press to ignore obvious abuses of power emanating from the Senate.

After the Supreme Court’s Citizens United decision on Jan. 21, 2010, Democrats adopted a campaign strategy of attempting to squelch the speech of conservative groups. Charles Schumer (D., N.Y.) – named in our complaint – introduced the so-called Disclose Act, saying on Feb. 11 that it would make targeted speakers “think twice” before speaking out. “The deterrent effect should not be underestimated,” he added.

At campaign fundraisers in the summer of 2010, President Obama repeatedly denounced conservative organizations for “running millions of dollars of attack ads against Democratic candidates,” identifying Americans for Prosperity by name. On Aug. 27 the Democratic Congressional Campaign Committee filed a complaint with the IRS against Americans for Prosperity.

Senate Democrats twice failed, on straight party-line votes, to end a filibuster of the Disclose Act. Mr. Obama told Democratic donors that they had “tried to fix” the problem but failed.

The attempt to silence opponents through legislation may be ugly, but such hardball politics are not a violation of Senate ethics rules. After failing to pass Disclose, however, the senators in our complaint began a pattern of improper conduct aimed at pressuring the IRS to harass and investigate their political opponents.

Senators may inquire about agency practices and operations. But they cross an ethical line when they interfere in pending tax exemption applications or pressure an agency to investigate or prosecute specific organizations.

Just days after the final defeat of the Disclose Act in October 2010, Sen. Richard Durbin (D., Ill.) – another senator in our complaint – wrote to IRS Commissioner Douglas Shulman on his official letterhead to demand that the IRS “quickly examine the tax status of Crossroads GPS,” a major conservative nonprofit.

Mr. Durbin accused Crossroads GPS of breaking the law. He later admitted to Chris Wallace on Fox News that he sought the investigation because “they were boastful about how much money they were going to raise and beat Democrats with.”

Pressure on the IRS increased after the 2010 midterm Republican landslide. Mr. Schumer stated in one speech, “It’s clear we’re not going to pass anything legislatively,” due to “Republican control” of the House. “But there are many things that can be done by the IRS… and we have to redouble our efforts. We have not worked hard enough on this.” In a letter to the IRS on March 12, 2012, Mr. Schumer urged the service to investigate various groups identified through reference to news articles.

Michigan Sen. Carl Levin wrote at least seven letters to the IRS, and demanded that it investigate specific nonprofits. The IRS’s failure to launch these investigations, he wrote in one, was “unacceptable.” Mr. Levin also sought confidential nonprofit tax return information from the IRS, even after being warned, repeatedly, by IRS Deputy Commissioner for Services and Enforcement Steven T. Miller, that such information could not be legally divulged.

These are just a few examples of abuse of power for electoral gain. The other six senators named in the complaint are Michael Bennet (D., Colo.), Sheldon Whitehouse (D., R.I.), Al Franken (D., Minn.), Jeanne Shaheen (D., N.H.), Jeff Merkley (D., Ore.) and Tom Udall (D., N.M.). Under the Senate Ethics Committee rules, when such a complaint is received – including by private individuals – “The Committee shall promptly commence a preliminary inquiry… of such duration and scope as is necessary” to find whether ethics rules were violated.

There is ample evidence that these efforts affected IRS policy, but the senators’ behavior is improper even if it did not. Senate rules require that the Ethics Committee take action. And we as citizens must make sure that the IRS is not abused by Democrats or Republicans for partisan electoral gain.

Newest IRS Targeting Scandal Documents Show Obama Regime Lied… Again (Video)

New IRS Revelations, And What The Obama Administration Is Doing Behind The Scenes – The Foundry

Could the IRS do anything to make itself more unpopular? Apparently, things are far from over with the agency’s targeting of conservative political groups.

Emails obtained by Judicial Watch and released yesterday indicate that the Obama administration lied when it tried to pin the scandal on IRS employees in an Ohio branch office. In fact, the Washington, D.C., office of the IRS was coordinating with the employees to hold up tea party groups’ applications for nonprofit status and subject them to extra scrutiny.

At the heart of the controversy is Lois Lerner, who was head of the division that approved nonprofit applications at the time.

“This latest revelation by Judicial Watch showing that the IRS targeting of conservative organizations was being run by its Washington office demonstrates that the House acted correctly when it held Lois Lerner in contempt,” said Heritage legal expert Hans von Spakovsky.

The House voted last week to hold Lois Lerner in contempt of Congress for refusing to answer questions about the IRS scandal. But it’s up to Attorney General Eric Holder to take any action – the first step of which would be forcing her to testify – and that hasn’t happened.

Von Spakovsky said:

Lerner claimed that this problem originated in the Cincinnati office of the IRS, so it is pretty clear she was misleading the public and congressional investigators. The contempt citation needs to be enforced and if the Justice Department refuses to do so, it will be another example of unethical behavior by a law enforcement agency that has repeatedly failed to adhere to its duty to enforce the law on an objective, nonpartisan basis.

In other words, the odds aren’t great that Lerner will face real consequences.

But perhaps the worst news is that the Obama administration has been working behind the scenes to change the rules for political activism – permanently.

In a new paper, von Spakovsky details how the administration has proposed rules for the IRS that “appear to be an attempt to implement the ‘inappropriate criteria’ used by the IRS to target tea party and other conservative organizations applying for tax-exempt status.”

Turning the IRS’s targeting of these organizations into actual rules, he explains, would:

* ignore Supreme Court precedents and the Internal Revenue Code;
* fail to provide clear guidance to citizens and organizations attempting to comply with the Code and accompanying regulations; and
* threaten to restrict or violate the First Amendment rights of Americans.

The IRS scandal has become a bipartisan concern, as evidenced by a number of Democrats voting to hold Lerner in contempt of Congress and voting to appoint a special counsel to investigate the scandal.

But the administration’s effort to rewrite the rules for political activity is an even more serious threat that must be stopped.

The powerful House Ways and Means Committee will get everything from disgraced former IRS official Lois Lerner’s email account since a few weeks before Barack Obama became president.

And Republican committee members are hoping they’ll find a smoking gun tying the Obama administration to the years-long scheme to play political favorites with nonprofit groups’ tax-exemption applications.

After eight months of back-and-forth stonewalling, the IRS has agreed to turn over the complete contents of Lerner’s email account, along with other documents that two congressional committees have been demanding.

‘If there’s not a Holy Grail email in this round of documents,’ a senior staffer to a Ways and Means committee member told MailOnline, ‘then we’re not going to find it.’

‘Whether that’s because Lerner covered her tracks or because the IRS is shredding documents, we’re probably never going to know.’

The committee’s chairman, Michigan Republican Rep. Dave Camp, seems eager to put his staff to work sifting through thousands of messages in search of an explanation for the program that has been a major embarrassment to the White House.

‘This is a significant step forward and will help us complete our investigation into the IRS’s targeting of conservative groups,’ Camp said Friday.

‘From the few Lerner documents we have received, we know that Washington, DC orchestrated the targeting of groups applying for tax-exempt status, surveillance of existing tax-exempt groups and formed the proposed 501(c)(4) rules designed to push conservative groups out of the public forum.’

Camp warned the IRS in a February 24 letter that he would start issuing subpoenas if the agency didn’t turn over the documents he wanted.

The IRS has proposed a rewrite of its regulations governing communications restrictions on ‘public benefit’ organizations that are exempt from paying federal income taxes.

That redesign of the rules began long before Lerner herself exposed the IRS’s pattern of holding up right-wing groups’ applications, often with dozens of intrusive questions over several years.

The effects of the agency’s desired rule change would be substantial: Organizations would be prohibited from emailing information, or publishing anything online, about candidates’ voting records during the last 60 days before an election.

Tea party groups, which began their rise to prominence five years ago, comprised most of the organizations that the IRS targeted beginning in 2010. Their political free-speech concerns have driven more than 146,000 public comments to the IRS, demanding that the regulatory revisions be scrapped.

Cleta Mitchell, a board member of the American Conservative Union Foundation, said Friday during that organization’s annual Conservative Political Action Conference that the new rules would affect the event where she was speaking.

‘It would mean that in even-numbered years, CPAC could have no speakers who are candidates for office,’ she said, dumbfounded.

Mitchell, an attorney, is representing some of the tea party groups in lawsuits related to the IRS targeting scheme.

The House Oversight Committee, chaired by California Rep. Darrell Issa, has cast a larger public shadow than Ways and Means has on the IRS targeting scandal.

Lerner has appeared before Issa-led hearings twice, both times invoking her Fifth Amendment rights and refusing to testify, despite President Obama’s insistence in a February interview that the IRS displayed ‘not a smidgen of corruption’ in the damaging episode.

Becca Glover Watkins, the Oversight Committee’s communications director, told MailOnline that Issa’s and Camp’s committee staffers are working hand-in-hand.

‘The Oversight Committee and the Ways and Means Committee have worked in partnership during the course of this investigation,’ Watkins said.

‘We expect the IRS will also be delivering a copy [of the complete Lerner files] to the Oversight Committee.’

A spokesperson for the Ways and Means Committee told MailOnline that it was the new IRS Commissioner, John Koskinen, who broke the inertia after months of requests.

‘We have been asking for the materials for months, and after many discussions the new IRS Commissioner has said the IRS will comply with the request,’ said the committee’s Sarah Swinehart.

Lerner ‘was clearly at the center of the IRS targeting and was running it out of the Washington, D.C. office,’ she added. ‘We expect her documents to provide a fuller picture of this.’

Koskinen took over the tax agency on December 23, ending a 13-month period during which two interim commissioners served as caretakers.

The IRS did not immediately respond to a request for comment.

Thursday afternoon True the Vote founder Catherine Engelbrecht filed an ethics complaint against Rep. Elijah Cummings alleging the Congressmen intimidated her and and her group.

Rep. Elijah Cummings on three separate occasions sent letters from the House Oversight and Government Reform, stating that he had concerns and felt it necessary to open an investigation on True the Vote.

The Congressman also smeared True the Vote in several cable news interviews in 2012. In the hearing today, Cummings accused True the Vote of racism saying that they were trying to suppress the vote.

“Franky, Megyn, the thought of having to sit before my accuser and be silent in the face of what we did was unconscionable… He filed over a period of months in 2012, he filed three letters that he sent to me asserting that he was opening an investigation.
