The Obama administration released thousands of illegal immigrant children to sponsors with criminal records, including arrests on charges of child molestation, human trafficking and homicide, a top senator charged Tuesday.

If true, it would be a stunning black mark on President Obama’s immigration record, according to analysts, who said the first job of the government was to protect the children from dangerous situations – and it apparently failed.

At least 3,400 children were placed in homes where sponsors had criminal records, said Sen. Chuck Grassley, chairman of the Judiciary Committee, citing information from a whistleblower.

“Allegedly, proper screening is not taking place and children are paying the price,” the Iowa Republican said in a letter demanding answers about the procedural breakdown from Homeland Security Secretary Jeh Johnson and Health and Human Services Secretary Sylvia Mathews Burwell.

HHS didn’t deny the numbers but said it does try to prohibit those with “serious” criminal records from sponsoring children and does conduct some level of background checks on all sponsors.

The accusations were made just as the Border Patrol confirmed another surge of illegal immigrant children along the southwestern border, with nearly 5,000 unaccompanied minors and 6,000 more women and children traveling together streaming across in October.

Those are huge increases over last October, when 2,500 unaccompanied children and fewer than 2,200 family members traveling together were caught at the border.

Customs and Border Protection officials said they were “closely monitoring this situation” and blamed smugglers for enticing would-be migrants to make the perilous journey by promising they can earn “permisos,” or free passes, once they reach the U.S. The permisos are the court appearance documents that the Border Patrol issues before releasing them into the interior of the U.S., where they can easily disappear.

In the case of unaccompanied children, the Border Patrol turns them over to the Office of Refugee Resettlement, which is part of HHS. That office then houses the children in dormitories until sponsors can be found for them.

But the pressure to handle tens of thousands of children at a time overwhelmed the office last year. As a result, the office handed over children to sponsors who were not properly vetted, according to Mr. Grassley and other analysts.

“They were so overwhelmed with cases they were more interested in processing them quickly than in making sure it was done safely,” said Jessica Vaughan, policy studies director at the Center for Immigration Studies. “They seemed to be operating under this delusion these were harmless kids being reclaimed by well-meaning relatives and there was nothing to worry about. And that is truly delusional.”

She said conducting background checks has become routine even for youth sports coaches and library volunteers and it’s stunning that the Obama administration doesn’t require that for someone who is taking full custody of a child.

HHS spokeswoman Andrea Helling said the department does try to vet the people it allows to sponsor children.

“It is not the practice of the Office of Refugee Resettlement to place unaccompanied children with sponsors who have serious criminal convictions. The safety of the children is our primary concern, and any allegation of even potential harm is taken seriously and will be investigated,” she said.

Under the Obama administration’s interpretation of the law, children caught crossing the border illegally without parents are deemed “unaccompanied alien children,” or UACs. They are supposed to be processed quickly by the Border Patrol and then turned over to HHS, which puts them in juvenile homes until they can be reconnected with relatives or placed in foster families.

That often meant placing them with relatives who themselves were in the U.S. illegally.

HHS, faced with nearly 10,000 children a month at the peak last summer, cut corners, including no longer requiring that all sponsors go through fingerprint checks. Fingerprints are required if a sponsor is not a parent or legal guardian, and in cases in which a child is considered particularly vulnerable.

HHS does conduct a background check that includes running a sponsor’s name through criminal databases, and they listen to see whether a sponsor “self-reports” a criminal history during the vetting process.

As of August, HHS also now conducts follow-up visits 30 days after a child is released to a sponsor. In May, HHS began accepting calls to its hotline for children or their sponsors to report on disruptions, including conflicts that could endanger the safety of a child.

Immigrant rights advocates involved in monitoring the children’s cases could not be reached for comment Tuesday.

But last year, at the height of the surge, one nonprofit estimated that as many as 10 percent of the children were sent to live in unacceptable or dangerous conditions.

Mr. Grassley said Tuesday that the whistleblower, whom he did not identify, raised his concerns with the Obama administration in August, yet the children identified as having been put in jeopardy have not been removed from those homes.

The whistleblower saw information on just a subset of 29,000 children, and 12 percent of them were placed in homes where sponsors had records. Extrapolating across the nearly 110,000 unaccompanied children caught at the border over the past two years, that could mean nearly 13,000 children may have been placed in dangerous situations.

Dorothy Bland, dean of the journalism school at the University of North Texas, was recently out walking one Saturday morning when she was pulled over by two cops, cops she now accuses of racism.

Bland penned a piece in the Dallas Morning News in which she stated that she was caught “walking while black.”

Bland wrote: “I stopped and asked the two officers if there was a problem; I don’t remember getting a decent answer before one of the officers asked me where I lived and for identification.”

She went on:

I remember saying something like, ‘Around the corner. This is my neighborhood, and I’m a taxpayer who pays a lot of taxes.’ As for the I.D. question, how many Americans typically carry I.D. with them on their morning walk? Do you realize I bought the hoodie I was wearing after completing the Harvard University Institute for Management and Leadership in Education in 2014?

She stated in her column that “I guess I was simply a brown face in an affluent neighborhood.”

Bland used her iPhone to capture the two officers and then their license plate in her picture.

Bland wrote she thought of “dozens” of blacks “who have died while in police custody,” and then posted the article to Facebook “for safety’s sake.” She then stated that she “posted the photo of the officers on Facebook, and within hours, more than 100 Facebook friends spread the news from New York to California.”

Little did Bland know that there was a camera installed in the police vehicle which captured the entirety of the incident.

Corinth Police Chief Debra Walthall replied to Bland’s comments about the incident in a column posted beneath Bland’s in The Dallas Morning News.

Walthall said that the stop was about safety, not race, and that the video from the camera installed in the police vehicle proves it.

In the video, the police officers clearly state the reason she was being pulled over – impeding traffic while walking and listening to her earbuds.

Walthall wrote: “My officers, a field training officer and his recruit, observed Ms. Bland walking in the roadway wearing earbuds and unaware that there was a pickup truck directly behind her that had to almost come to a complete stop to avoid hitting her.”

She also wrote: “Impeding traffic is a Class C misdemeanor, and it is our policy to ask for identification from people we encounter for this type violation.”

Walthall said that after people watch the video, they will be sure that the officers were concerned about keeping her safe.

Yet Another Sickening Planned Parenthood Video Released

The Center for Medical Progress released another Planned Parenthood video today. It once again features Holly O’Donnell, a former technician for StemExpress, one of the buyers of baby parts from Planned Parenthood. The video consists mostly of Miss O’Donnell describing an incident in which a baby’s heart was still beating, and she was instructed to cut through the baby’s face so that his brain–the baby was a boy–could be removed for sale. It is utterly appalling.

There have been multiple hints in the CMP videos that some babies are born alive and then killed by Planned Parenthood. That appears to have been true in this case, and there is another such suggestion from a different witness. I would think that at a minimum, a criminal investigation is warranted.

Warning: this video is not for the faint of heart. I am not a sensitive guy, but I had to steel myself to watch it.

The liberal media are generally trying to ignore the CMP videos, hoping the controversy they have caused will go away. The New York Times is typical: it has not yet mentioned today’s video. It hasn’t covered the content of the videos, except to misrepresent them and to defend Planned Parenthood. For example, today’s Times includes a story on a Reuters poll that is headlined, “Americans back federal funds for Planned Parenthood health services: poll.” The poll asked about women’s health exams, prenatal services and contraception, not abortion. The Times story begins:

Americans broadly support providing federal funding for free women’s health exams, screenings and contraception services, a Reuters/Ipsos poll has found, suggesting risks for Republicans criticizing Planned Parenthood as part of the 2016 campaigns.

Notice how the reporter defaults straight to politics. Happily, not many Republicans take campaign advice from the Times.

The non-profit’s image has taken a hit, the poll found, after an anti-abortion group earlier this year began releasing videos purporting to show Planned Parenthood officials negotiating prices for aborted fetal tissue.

The Times tries to keep alive the fiction that there is some doubt about what the videos show. The videos do not “purport” to show PP officials negotiating prices for aborted babies’ body parts. They show PP officials negotiating prices for aborted babies’ body parts. They show a lot more than that, too.

You have to read to the very end of the Times story to be told that the Reuters poll is actually bad news for Planned Parenthood:

But 44 percent of respondents who saw the videos said they now have a more negative view of Planned Parenthood, compared with 34 percent who said their views were unchanged.

Those 34% must have had an awfully negative view of PP to begin with. This is the kicker:

After the videos were described to poll respondents, 39 percent said Planned Parenthood should not receive government funding and 34 percent said federal dollars should continue.

Imagine what the reaction would have been if respondents had been told that PP extracts brains from babies with beating hearts.

Maybe the most significant aspect of the Reuters poll is that 37% said they have seen at least one of the CMP videos. That number will inexorably continue to rise. So the left’s effort to suppress the news about what the videos show hasn’t been very successful.

Obama released a top Iranian scientist as part of the deal but left the Americans to rot in hell in Iranian prisons.

Mojtaba Atarodi, arrested in California for attempting to acquire equipment for Iran’s military-nuclear programs, was released in April as part of back channel talks, Times of Israel told. The contacts, mediated in Oman for years by close colleague of the Sultan, have seen a series of US-Iran prisoner releases, and there may be more to come.

The secret back channel of negotiations between Iran and the United States, which led to this month’s interim deal in Geneva on Iran’s rogue nuclear program, has also seen a series of prisoner releases by both sides, which have played a central role in bridging the distance between the two nations, the Times of Israel has been told.

In the most dramatic of those releases, the US in April released a top Iranian scientist, Mojtaba Atarodi, who had been arrested in 2011 for attempting to acquire equipment that could be used for Iran’s military-nuclear programs.

No wonder he didn’t want reporters talking about it!

A Haitian immigrant who was released from prison in January after serving a sentence for attempted murder is back in custody on a murder charge in the death of a Connecticut woman last month.

The Bulletin reported that Jean Jacques’s prison file was marked “Detainer: Immigration” and that Connecticut officials say he was released in January to the custody of the U.S. Department of Immigration and Customs Enforcement.

His crimes also included the illegal use of a gun during a 1996 deadly shooting, qualifying him for deportation to his native Haiti, the newspaper reported. ICE spokesman Shawn Neudauer told the newspaper federal privacy laws prohibit him from discussing Jacques’ case.

On Monday, the 40-year-old Jacques was in New London Superior Court to answer to murder and drug charges, stemming from the June 15 stabbing death of Casey Chadwick at her apartment in Norwich, the city where Jacques lived before he went to prison. The 25-year-old woman’s body was found stuffed in a closet.

Jacques was brought in a wheelchair after he refused to enter the courtroom willingly. He also kept his eyes closed, refused to respond to court officials, and would not talk to a Creole interpreter or one of his public defenders…

…The Bulletin reported that at his June 25 arraignment in Norwich Superior Court, Judge Kevin McMahan said: “You had a murder conviction and you weren’t deported? OK.”

Norwich Police Chief Louis Fusaro Sr. said it was discomforting that Jacques wasn’t deported after his prison release.

More than 3,700 “Threat Level 1” criminal immigrants were released from custody last year, according to new data obtained by Congress and revealed by The Washington Times.

A report from The Times details how data from the Department of Homeland Security, obtained by House Judiciary Committee Chairman Bob Goodlatte (R-VA), show that the 57 percent of criminal immigrants released last year were discretionary – or the choice of Immigration and Customs Enforcement.

“Put aside the spin, and the fact is that over 17,000 of the criminal aliens released last year were released due to ICE discretion, representing 57 percent of the releases,” Goodlatte told The Times. “The Obama administration’s lax enforcement policies are reckless and needlessly endanger our communities.”

Last fiscal year ICE released more than 30,500 criminal immigrants from custody. Of the discretionary releases, The Times reports, more than 3,700 represented top threats.

The Obama administration has argued that many of the releases are due to a 2001 Supreme Court case, Zadvydas v. Davis, which prohibited the prolonged detention of immigrants if their deportation was unlikely in the near future, often in circumstances in which their country will not take them back.

The Times notes that with the new data, Goodlatte argues that releases due to the Zadvydas case were just 8 percent of the overall releases or 2,500 last year and the rest were either ordered by a judge or ICE failed to obtain travel documents.

ICE explained to The Times in a statement that each case is a judgement call.

“Not all Level 1 criminal aliens are subject to mandatory detention and thus may be eligible for bond,” ICE said to The Times.

“ICE personnel making custody determinations also take into consideration humanitarian factors such as deteriorated health, advanced age, and caretaking responsibilities. All custody determinations are made on a case-by-case basis taking into consideration the totality of circumstances in each case,” It added.

And while ICE looks to alleviate concerns by pointing out it continues to monitor those criminal immigrants it releases, according to The Times, the monitoring often fails to deter criminal immigrants from violating the terms of their release.

Pinal County, AZ Sheriff Paul Babeu (R) said that he cannot get access to the names of the nearly 500 criminal illegal immigrants released in his county on Tuesday’s “Your World with Neil Cavuto” on the Fox News Channel.

“30,000 this year, 36,000 the year prior, and these aren’t the run of the mill illegals. There’s 11 to 20 million illegals that are here in the United States. This is the group that everybody, even President Obama, said that are the worst of the worst actors, that everybody agreed need to be shipped out of our country back to their country of origin. There [were] 193 of them that were convicted of murder. 300-plus that were convicted of rape and sexual assault, and there [were] another 200 to 300 that were convicted of kidnapping [that were released in 2013]. So, these are the worst criminals in our society, and they were not returned to their country of origin because of what she [ICE Director Sarah Saldana] said and Jeh Johnson said, ‘well, their countries don’t want them back’” he stated.

Babeu added, “we have no clue where they’re at today… they released nearly 500 in my county alone… I have demanded not only in formal letter, through FOIA, and legally have even talked to Senator McCain. Senator McCain, who’s a powerful Senator, said, ‘Sheriff, I promise you, I’m going to get you these names.’ He can’t get me the names. Nobody will get me these names, and the reason why they will refuse to provide the names is then we have a list of all these illegals that our government – President Obama has released into our communities that are committing new crimes, that are committing murder, that are committing rape, that are committing aggravated assault, armed robbery, and then we can directly link them back to the president’s action of this unlawful mass prison break.”

On Wednesday afternoon, Hussein Obama held a closed door, secret meeting with what are described as American Muslim leaders in the White House. Despite attempts by the press to obtain information as to the identities of the visitors, that information was not being provided.

Perhaps some Muslim leaders don’t want people to know that they are associating with Hussein Obama, and that would be a truly understandable position for any self-respecting American to adopt. In that case perhaps their individual name might have somehow been kept of the record or secret, though it might be difficult. In this case, with the entire list of attendees being withheld, the only reasonable source of that decision must be the White House itself. They have control of the information, individual attendees do not.

Since the decision must have come from the White House, the only plausible explanation is that there were attendees at his meeting who they did not want the American people to know Obama was hosting. The only logical reason for wanting to keep their identities private is because they have extreme views or attachments to radicals, radical groups or terrorist organizations.

Brietbart reported that the regime released a readout of the meeting which consisted of the general topics of “a range of domestic and foreign policy issues” which included “Obamacare, police fairness, anti-Muslim discrimination, and the upcoming Summit on Countering Violence Extremism.”

In the face of increased public concern over the threat of a terrorist attack, the regime’s failure to respond in a timely manner and participate in the French march and yesterday’s ISIS video of the murder of the Jordanian pilot, what Hussein Obama is concerned with is whether or not Muslims are being treated properly.

The readout also noted, “The President discussed the need to continue countering ISIL and other groups that commit horrific acts of violence, purportedly in the name of Islam.” It’s no surprise that an obligatory entry in the agenda summary, an afterthought it appears, was made to deflect the criticism that might have arisen if the topic of Islamic terrorism were left out of the discussion entirely.

Josh Earnest, running the typical, daily cover for the subversives in the White House, said, that it wasn’t unusual for Hussein Obama to meet with “a wide variety of communities from across the country.” He then included this particular meeting into the “not unusual” category by saying, “Sometimes that includes religious leaders; sometimes that includes leaders that are involved in academia or other specific issue areas.”

Just what other specific issue areas that might be was also part of the secret being kept by this least transparent regime in American history.

Justina Pelletier is coming home.

A Massachusetts judge ordered the 16-year-old Connecticut girl, who was taken from her family by child welfare advocates more than a year ago, to be returned to her mother and father effective Wednesday. The ruling caps a long-running medical custody dispute that began when two highly-respected Boston hospitals clashed over the girl’s diagnosis. The case sparked national outrage, and led Lou and Linda Pelletier, of West Hartford, Conn., to wage a bitter legal battle.

“To hear the news is overwhelming,” Lou Pelletier told FoxNews.com moments after learning of the ruling. “Now we can certainly begin the healing process.”

The case began when the girl’s parents disagreed with a psychiatric diagnosis given by Boston Children’s Hospital and said they wanted their daughter returned to her original physician at Tufts Medical Center, who had previously treated Justina for mitochondrial disease, a group of rare genetic disorders affecting cellular energy production. The Massachusetts Department of Children and Families moved in, claiming Justina was the victim of “medical child abuse.”

Mat Staver, of the Liberty Counsel, which battled the Bay State bureaucracy on behalf of the Pelletiers, said the ruling handed down by Massachusetts juvenile court Judge Joseph Johnston was well-deserved.

“We are thrilled that Justina will finally be returning home,” Staver said in a statement. “The family looks forward to putting this 16-month nightmare behind them. Justina and her family now begins the process of healing both physically, emotionally, and spiritually.”

In May, Justina was moved from Massachusetts to a facility in Thompson, Conn., allowing her parents to visit with their daughter, but doing little to dampen their determination to win her back for good. In a 45-second, videotaped plea, first posted on a Facebook support page last week, Justina is seen sitting in a chair and pleading plaintively with Johnston.

“All I really want is to be with my family and friends,” the girl says, her voice faltering at times. “You can do it. You’re the one that’s judging this. Please let me go home.”

The judge granted the girl’s wish, after the Massachusetts DCF filed a motion agreeing that the teenager should be returned to her family. Alec Loftus, a spokesman for Massachusetts Health and Human Services Secretary John Polanowicz, confirmed to FoxNews.com last week that the agency was no longer planning to fight the case.

The emotional toll on Justina and her family is one that cannot be measured, Staver said. She has missed out on two years of education, Staver said, and went from becoming a competitive figure skater to being confined in a wheelchair.

Lou Pelletier said he knows his daughter will need time and love from her family to overcome her ordeal.

“She’s coming home tomorrow,” he said. “I think she will want to get adjusted.

“Think of it like a prisoner of war who has been held captive for 16 months,” he continued. “There will be an adjustment period.”

Nearly 200 murderers, over 400 rapists, and 300 kidnappers in the U.S. illegally were released by Immigration and Customs Enforcement while awaiting deportation proceedings, according to a new report from the Center for Immigration Studies.

A total of 36,007 criminal illegal immigrants that were being processed for deportation were freed in 2013. Together, they committed nearly 88,000 crimes, according to the report, published Monday.

“I was astonished at not only the huge number of convicted criminals who were freed from ICE custody last year – an average of almost 100 a day – but also at the large number of very serious crimes they had committed,” said Jessica Vaughan, the director of policy studies at the Center for Immigration Studies, in a statement.

ICE gathered the statistics – which include a breakdown by crime – in response to congressional inquiry following another report released earlier this year by the Center of Immigration Studies.

That report, which was based on internal Department of Homeland Security documents, showed that ICE encountered over 193,000 illegal immigrant convicts. Charging documents were issued for 125,000, and nearly 68,000 were released.

That review also found that 870,000 illegal immigrants had been removed from ICE dockets despite being in defiance of the law. The number of illegal aliens targeted for deportation fell 28 percent between 2012 and 2013, according to the documents.

The 36,007 illegal immigrants reported Monday were freed by ICE during the final disposition of their cases. The 68,000 from the previous report were criminals who encountered ICE agents – often in jails – but were released without undergoing deportation proceedings.

The 36,007 were released by bond, parole, unsupervised release, or on their own recognizance.

Besides violent criminals, ICE released nearly 16,000 illegal immigrants convicted of driving under the influence. The report also shows that ICE released nearly 2,700 illegal immigrants convicted of assault, 1,300 convicted for domestic violence, and nearly 1,300 convicted for battery.

“These figures call into question President Obama’s request to Congress for permission to reduce immigration detention capacity by 10 percent in favor of permission to make wider use of experimental alternatives to detention,” reads the report.

In June 2011, the administration began applying “prosecutorial discretion” to many deportation cases. This has led to a 40 percent decrease in the number of deportations.

“Congress should resist further action on immigration reform until the public can be assured that enforcement is more robust and that ICE can better deal with its criminal alien caseload without setting them free in our communities,” said Vaughan in a statement.

A Center for Immigration study to be released Monday and obtained in advance by The Daily Caller, found that last year ICE reported nearly 722,000 encounters with illegal or criminal immigrants. But ICE officers filed immigration charges against less than 195,000 aliens.

“According to ICE personnel, the vast gap between the number of encounters reported and the number of aliens put on the path to removal exists because officers are not permitted to file charges against aliens who do not fall into the administration’s narrowly defined criteria for enforcement, regardless of the criminal charges or the circumstances in which the alien was identified,” the report, authored by CIS director of policy studies Jessica Vaughan, reads.

Since June 2011, when the first of the Obama administration’s “prosecutorial discretion” policies were put in place, the report adds, interior ICE arrests have declined by 40 percent.

“The Obama administration and anti-enforcement activist groups have tried to portray the number of departures as ‘record-breaking’ and indicative of robust immigration enforcement. They have tried to support this claim by showing that the number of departures credited to ICE is higher than ever before,” the report reads. “However, an independent analysis of ICE records obtained in a lawsuit showed that ICE was able to achieve these ‘record’ departures only because the agency was taking credit for removing a large number of individuals who were apprehended by the Border Patrol. Such cases made up the majority of ICE’s reported deportations in 2013, but they had never been counted that way in previous administrations.”

Indeed, as the review highlights, many aliens with criminal convictions have simply been released.

In 2013 some 68,000 criminal aliens were released – or 35 percent of all criminal aliens ICE reported encountering, according to the report. ICE field offices with the highest rates of criminal releases were San Antonio (79 percent), New York City (71 percent), Washington, D.C. area (64 percent), and Newark, N.J (60 percent).

“These figures suggest that despite claims of a focus on public safety, the administration’s prosecutorial discretion criteria are allowing factors such as family relationships, political considerations, or attention from advocacy groups to trump criminal convictions as a factor leading to deportation,” the report reads.

The data is sure to further frustrate critics of the Obama administration’s immigration policies that much more.

Including Alabama Republican Sen. Jeff Sessions who says the “[Department of Homeland Security] is a department in crisis” and is calling on DHS Sec. Jeh Johnson to “reject the President’s demands to weaken enforcement further and tell him that his duty, and his officers’ duty, is to enforce the law – not break it.”

“As Homeland Secretary, Mr. Johnson is tasked with ensuring the public safety and the rule of law. But Secretary Johnson is not meeting these duties,” Sessions said statement to TheDC. “American citizens have a legal and moral right to the protections our immigration laws afford – at the border, the interior and the workplace. The administration has stripped these protections and adopted a government policy that encourages new arrivals to enter illegally or overstay visas by advertising immunity from future enforcement.”

“Comments from top Administration officials, such as Attorney General Holder’s claim that amnesty is a civil right, or Vice President Biden’s claim that those here illegally are all U.S. citizens (apparently including someone whose visa expired yesterday), demonstrate the administration’s increasing belief in an open borders policy the American public has always rejected,” he added.

According to Vaughan, Congress should initiate an official look into the impact of the administration’s prosecutorial discretion policies.

“The Obama administration’s deliberate obstruction of immigration enforcement, in which tens of thousands of criminal aliens are released instead of removed, is threatening the well-being of American communities,” she said.

To Sessions, however, it is Republicans who must work to hold the administration accountable for its rejection of the law.

“The Administration’s lawless policies have not only impaired public safety but increased economic suffering for millions of vulnerable Americans by depriving them of their jobs and wages,” he said. “Unfortunately, Congressional Democrats continue to empower this lawlessness. Republicans must work to end it.”

Other key findings in the review include:

* In 2013, ICE charged only 195,000, or 25 percent, out of 722,000 potentially deportable aliens they encountered. Most of these aliens came to ICE’s attention after incarceration for a local arrest.

* ICE released 68,000 criminal aliens in 2013, or 35 percent of the criminal aliens encountered by officers. The vast majority of these releases occurred because of the Obama administration’s prosecutorial discretion policies, not because the aliens were not deportable.

* ICE targeted 28 percent fewer aliens for deportation from the interior in 2013 than in 2012, despite sustained high numbers of encounters in the Criminal Alien and Secure Communities programs.

* Every ICE field office but one reported a decline in interior enforcement activity.

* ICE reports that there are more than 870,000 aliens on its docket who have been ordered removed, but who remain in defiance of the law.

* Under current policies, an alien’s family relationships, political considerations, attention from advocacy groups, and other factors not related to public safety can trump even serious criminal convictions and result in the termination of a deportation case.

* Less than 2 percent of ICE’s caseload was in detention at the end of fiscal year 2013. About three-fourths of the aliens ICE detained in 2013 had criminal and/or immigration convictions so serious that the detention was required by statute.

ICE Spending Taxpayer Money To House Illegals In Hotel Rooms, Others Released Into U.S. Population

A sudden influx of illegal immigrants from Mexico requesting asylum is overwhelming immigration agents in San Diego, forcing agencies to rent hotel rooms for some undocumented families and release others to cities around the U.S.

Documents obtained exclusively by Fox News show Immigration and Customs Enforcement has been paying for hotel rooms for dozens of recently arrived families to relieve overcrowding inside the San Ysidro and Otay Mesa, Calif., processing centers. Some ICE employees are working overtime and others have been asked to volunteer to work weekend shifts. “Duties include intake, placements, transports and release of family groups and unaccompanied minors,” according to a memo obtained by Fox News.

The surge has raised suspicions about what is driving the influx, amid claims that illegal immigrants have learned they can attempt to get asylum by using a few key words – namely, by claiming they have a “credible fear” of drug cartels.

“This clearly has to have been orchestrated by somebody,” said former U.S. Attorney for Southern California Peter Nunez. “It’s beyond belief that dozens or hundreds or thousands of people would simultaneously decide that they should go to the U.S. and make this claim.”

Sources say one day last week, 200 border-crossers came through the Otay Mesa Port of Entry claiming asylum while and as many as 550 overflowed inside the processing center there and in nearby San Ysidro.

“People were sleeping on floors – they had nowhere to put them,” said one source, a long-time border agent and supervisor. “This shouldn’t be happening. Unless there is an immediate and well-publicized policy change, this situation will become another debacle.”

At a hotel near San Diego – which Fox News agreed not to identify for security reasons – ICE vans arrived several times over the weekend with immigrant families. They were escorted to the second floor by two armed, uniformed agents. Two border agents secured the entrance and side door.

Documents obtained by Fox News show that recently on a single day, dozens of illegal immigrants were being transferred to an area hotel where rooms cost $99 a night. Others were released to addresses in Texas, Florida and even Brooklyn, N.Y.

ICE sources say the addresses are almost always bogus. When they don’t show up for court, they are removed by an immigration judge in absentia.

Most of the immigrants came from Mexico, but others listed their native country as Haiti, Romania, Guatemala and Iraq. Some were over age 50, others were under a year old. Thirty were transported to a hotel. Seventy were released around the country.

Fox News spoke to four agencies responsible for the San Diego situation last week. All deferred to the Department of Homeland Security press office in Washington, D.C., which issued this statement:

“Credible fear determinations are dictated by long standing statute, not an issuance of discretion. The USCIS officer must find that a ‘significant possibility’ exists that the individual may be found eligible for asylum or withholding or removal.

“If the credible fear threshold is met, the individual is placed into removal proceedings in Immigration Court. The final decision on asylum eligibility rests with an immigration judge.”

It is during this time – during removal proceedings – when illegal immigrants are released. Many don’t show up, as 91 percent of asylum claims from Mexico are denied.

Asylum claims from Mexico are highly unusual and critics say this is an orchestrated sham – it’s not about getting asylum, they say, but about overwhelming the system and getting a free pass into the U.S. and a court date for which no one will show up.

“Hundreds of thousands of people have never returned and the list of people for whom warrants are outstanding is phenomenal,” said Nunez. “We have a long history of people absconding from immigration hearings of one sort of another, they just blend back into the community.”

ICE sources say an estimated 600,000 to 800,000 illegal immigrants a year do not show up for their court date and disappear into the U.S.

The number of asylum claims is on the rise, almost tripling the last four years. Most come from Chinese, Egyptian and Ethiopian immigrants. Fewer than 200 a year come from Mexico, let alone 200 in a day. However, by claiming they have a “credible fear of persecution” if returned to Mexico, the immigrant is entitled to a series of interviews, hearings, proceedings and appeals that can drag on for years.

The initial evaluation usually is done in the border processing center by an asylum officer employed by USCIS.

An immigration spokesman said last week: “The legal threshold for ‘credible fear’ is broad and low to ensure individuals who may face a ‘significant possibility’ of persecution… have the opportunity to have their case heard before an immigration judge.”

Last week, an asylum officer heard the claims of the “Dream 9,” nine Mexican nationals brought to the U.S. as children. Even though seven of the nine lived, worked and went to school in Mexico without incident, they were granted asylum. Most thought they would be deported.

“The order from Washington are to simply turn these people loose,” said Ira Mehlman, a spokesman for the Federation for American Immigration Reform. “All you have to say is you qualify for the Dream Act and or you intent to apply and they’re instructed by their higher ups to simply turn these people loose, to set them free and let them pursue any path they want.”

There are 57 immigration courts and 231 immigration judges. Immigration courts handle 280,000 proceedings each year – an average of 1,243 per year per judge, or four decisions per day.

Asylum can be granted if the applicant has suffered past persecution or has a “well-founded fear of persecution” on account of race, religion, nationality, membership in a social group, or political opinion in their native country.
