Nebraska Abolishes Civil Forfeiture – Daily Signal

Nebraska Gov. Pete Ricketts, a Republican, has signed a major state forfeiture bill into law. Like New Mexico before it, the Cornhusker State now requires a criminal conviction before property can be forfeited.

Civil forfeiture is the law enforcement tool, which allows property suspected of being involved in, or derived from, criminal activity to be seized by police, sheriffs, and federal agents. It was ramped up in the 1980’s as a means of combatting the drug trade and organized crime, with the goal of stripping kingpins of their assets and ill-gotten gains.

Thirty years later, though, forfeiture has morphed into a system that is far more often used to seize relatively small amounts of cash, that stacks the deck against property owners fighting to get it back, and that encourages profiteering by law enforcement authorities….

Solar Developer SunEdison In Bankruptcy As Aggressive Growth Plan Unravels – Reuters

SunEdison Inc SUNE.N, once the fastest-growing U.S. renewable energy company, filed for Chapter 11 bankruptcy protection on Thursday after a short-lived but aggressive binge of debt-fueled acquisitions proved unsustainable.

In its bankruptcy filing, the company said it had assets of $20.7 billion and liabilities of $16.1 billion as of Sept. 30.

A former luxury hotel-turned migrant centre in Austria is the site of an outbreak of a deadly bacterial disease which has seen at least one migrant put into intensive care.

The outbreak of louse-born relapsing fever is just the latest re-emergence of diseases long thought exterminated in Europe, carried back to the continent by a great migratory movement of millions of people from Africa and Asia. Particularly associated with Ethiopia, Sudan, Eritrea, and Somalia, the extremely contagious bacteria causes severe illness and can be fatal in 30 to 70 per cent of cases, according to the Centre for Disease Control and Prevention.

If untreated, the disease has a similar fatality rate to that of the 2015 West African Ebola outbreak.

Health authorities in Austria reacted immediately to the outbreak, reports Kronen Zeitung. Salzburg chief of public order Dr. Michael Haybäck said of the urgent measures taken to contain the infection: “According to Article 6 of the Law on Epidemics, we take all necessary measures without delay to meet a suspected case”.

The luxurious alpine country resort hotel Kobenzl was placed under quarantine, with rooms placed in lock-down and completely disinfected. Given that body lice are the main vector for the disease, the cleaning of mattresses and clothes was given especial priority.

Now all migrants living at the hotel will be required to wash their clothes at 60 degrees for the next six weeks, two weeks beyond the approximate life span of an infected louse. The other residents of the hotel are presently being examined to determine whether there are more cases to come, reports Salzburg24, but it is not presently known how many cases have been detected in total.

All staff at the centre have been issued with protective disposable clothing for their work with the migrants.

Borrelia recurrentis, the bacteria transferred from infected lice to humans which causes Relapsing Fever was a global disease a century ago until it was eradicated in Europe. It ravaged eastern Europe in the immediate aftermath of the Great War and during the Russian revolution, killing five million people from 13 million known cases between 1919 and 1923.

Migrants have been credited with a host of other diseases appearing in Europe again, in some cases for the first time in decades. As reported by Breitbart London, European hospitals have seen Diphtheria, Tuberculosis, And Malaria cases in historic numbers in the past year.

Amy and Esther Juárez were edgy with excitement as they boarded the bus full of seasonal workers heading for a farm at the other end of Mexico from their home in the poverty-stricken southern state of Chiapas.

Although their brother Alberto,18, had made the same journey the previous year, it was the first time Amy, 24, and Esther, 15, had left the tiny indigenous community where they had grown up.

But about half-way there, immigration agents boarded the bus, and after checking all the passengers’ papers, ordered the three siblings to get off.

The officials accused them of carrying false documents and lying about their nationality. Then they told the youngsters that they would be deported to Guatemala, a country none would have been able to place on a map.

The baffled youngsters – who speak the Mayan language Tzeltal but very little Spanish – were transferred to an immigration holding centre in Queretero CITY.

Alberto, 18, was taken into a separate room by four agents who told him that unless he signed documents admitting he was Guatemalan, would die there.

“One pushed me, another was kicking my leg, and a third who was very fat gave me an electric shock here, on the back of my right hand,” Alberto told the Guardian through a translator.

“I really thought I was going to die, so I signed lots of sheets of paper – but I can’t read or write so I didn’t know what I was signing.”

The three siblings were held for eight days before a lawyer from an activist group filed a legal complaint and eventually secured their release.

A growing number of indigenous Mexicans are being detained and threatened with expulsion by immigration agents looking for undocumented Central American migrants.

The trend comes amid a crackdown on migrants driven in part by political pressure and financial aid from the US. Deportations have already risen exponentially since summer 2014 when Barack Obama declared the surge in Central American child migrants a humanitarian crisis. Campaigners say that Mexico migration officials are running a secret quota system to increase the number of expulsions.

Activists say that Mexico’s National Immigration Institute is increasingly operating like an unchecked police force – and say that that like the country’s security forces, it appears to be systematically using torture against detainees.

“The order appears to be to detain Central Americans at any cost, even if that means violating the constitution, picking up people based on racist criteria and detaining and deporting Mexican indigenous youth along the way,” said Gretchen Kuhener, director of the Institute for Women in Migration (IMUMI), which launched legal action to secure the siblings’ release. The Mexican constitution states that citizens can move freely within the country, and do not need to carry ID.

Kuhener added: “This case demonstrates the power and impunity of the National Migration Institute. They can get away with it because it impacts highly vulnerable populations who may not speak Spanish, don’t know their rights, and are unlikely to complain.”

The Juárez family live amid the picturesque rolling hills in eastern Chiapas, where all seven children – aged six to 24 – help their parents eke out a living from a few plots of land.

Food is plentiful, but money is scarce, and to top up their incomes, thousands of people, many of them indigenous, travel by bus from Chiapas and other southern states to work on farms in northern Mexico.

In Chiapas, casual farmhands earn 60 to 80 pesos (£2.40 to £3.20) a day cutting coffee, whereas last season Alberto earned 200 pesos (£8) a day harvesting squash, watermelons and tomatoes in the northern state of Sonora.

Gently swinging in a hammock, Alberto said his first time away from home was thrilling.

“We worked hard, but went out every evening. I tried hamburgers for the first time, and there was electricity where we lived. When I came home after seven months, I bought a horse with the money I’d saved. This year I wanted to buy motorbike.”

Encouraged by Alberto’s stories, his sisters and Esther’s boyfriend Fernando, 27, also signed up when the contractors returned looking for workers. All four asked not to be identified by their real names, for fear of reprisals from the Mexican authorities.

“I just wanted to have my own money so I could buy my own clothes at the market, maybe some earrings,” said Amy, 24. “But even as we got on the bus, I had a bad feeling.”

The privately contracted bus left on 2 September 2015 at 2pm from the local petrol station. The following afternoon, at a tollbooth just south of the border with Queretaro state, immigration agents boarded the bus.

Mobile immigration teams were introduced as part of the crackdown – known as the Southern Border Plan – launched amid US pressure to stop Central American migrants reaching its border.

Although immigration officials do not carry weapons, they often work closely with armed private security officers, police officers and soldiers. The joint units have been aggressive in their attempts to stop northward migration, raiding bus stations, motels and buses, and stopping migrants from boarding the freight train known as the Beast, which was once a major route through southern Mexico.

The scale of US financial support for Mexican immigration control is opaque. At least $100m has been spent or pledged for training, new equipment and canine teams, according to Congressional Research Service. There are no human rights conditions attached to this aid. Department of Defence aid is separate and unknown. The INM said it has “never received a peso” from the US.

After being held at the roadside for several hours, the Juárez siblings were driven to the immigration centre. Officials confiscated their belongings, including a cellphone and documents (birth certificates, social security numbers, electoral registration) which the officials insisted were fake.

Months later, the siblings are still shaken by the experience, and asked to be identified with pseudonyms for fear of retribution from migration officials

Esther, 15, said the experience was terrifying. “They kept saying we were Guatemalan, and we kept telling them no, we’re from Chiapas but they wouldn’t believe us and became angrier and angrier.”

On Friday 4 September, after being kicked, pushed and given an electric shock, Alberto signed documents he couldn’t read admitting he was Guatemalan.

Agents told them they would be deported to San Marcos, a poverty-stricken city in western Guatemala. Incredibly, a Guatemalan consul issued certificates “confirming” their nationality.

“Alberto couldn’t stop shaking, we were all crying. How would we return home to Chiapas when we don’t even know where Guatemala is?” added Esther.

Esther’s boyfriend Fernando, who was accused of being a people smuggler but not detained, managed to find help. The IMUMI lawyer arrived on 6 September, and filed a legal complaint, and after eight days, the trio were released.

Their ID documents were not returned because they could not pay the £8 (200 pesos) bribe demanded by officials.

A specialist psychologist and doctor from the Mexico City Human Rights Commission concluded – in a report seen by the Guardian – that Alberto had suffered serious physical pain and post-traumatic psychological symptoms as a result of being tortured.

Carolina Jiménez, deputy director of research for the Americas at Amnesty International, said: “We have documented a truly disturbing pattern of very serious human rights violations against migrants travelling through Mexico. But seeing immigration officials involved in torture against Mexican nationals to make them ‘confess’ they are migrants takes this disturbing situation to a whole more sinister level.”

Concern over the conduct of immigration agents is rising. Advocacy groups were dismayed when Ardelio Vargas, a highly controversial police figure, was named head of INM in January 2013. Vargas was in charge of federal forces when peasant protests in the town of San Salvador Atenco were violently repressed by police in 2006.

Alejandro Martínez, former head of Central American migrants’ issues at the INM, said Vargas runs the institute like a police force.

“The biggest mistake was to mix police and immigration. [The case of the Juárez siblings] makes me even more certain that illegal quotas within the institute are driving the exponential rise in detentions. It doesn’t matter how agents do it, as long as they meet the quotas.”

INM categorically denied the use of quotas. But the huge surge in detentions and deportations is undeniable. In 2015, 190,000 people were detained by INM agents – 120% more than in 2013.

It also appears Mexican nationals with a particular profile are being caught up in the swell.

The National Commission for Human Rights (known in Spanish as the CNDH) recently investigated 15 similar cases – including at least eight other victims from Chiapas – and found 22 immigration agents violated multiple rights.

The victims were detained on buses or on the street solely based on their “physical features, clothes and appearance”. Some were detained for several weeks before convincing officials they were Mexican.

The INM said agents are legally permitted to request identification from anyone.

According to the INM spokeswoman, the Juárez siblings were detained because Fernando said they were Guatemalan, and the sisters’ ID papers raised concerns they could be human trafficking victims. Their detention was prolonged by IMUMI’s legal challenge, she said.

She added: “It’s impossible that anyone could be tortured at an immigration station because they are permanently monitored by the CNDH, international organisations like the Red Cross and NGOs. If he [Alberto] was tortured, why not report it at the time, why wait till later?

“As in all cases of possible abuse there will be an investigation and if we find any evidence of excessive force, those responsible will be reported to the competent authorities.”

A lawsuit over the case is still ongoing, but whatever its outcome, the episode has shattered the dreams of the Járez sibling. Amy and Esther say they will never leave their community again because it is simply too dangerous.

Alberto muses over the future while watching his elegant white mare grazing with her chestnut foal. He had big dreams of building his own house with electricity and internet, and he still wants that motorbike.

“I want to go north again to work, but I keep thinking about what they did to me. It’s best that I stay here.”

A mob of 30 migrants chased three teenage girls through a German mall before threatening police officers, local media has reported.

The men, thought to be from Afghanistan, are said to have used their smartphones to film the girls at the Sophienhof mall in Kiel, Schleswig-Holstein state.

Police officers were called out after several shoppers reported that 30 men of ‘immigrant background’ were following the girls, aged 15, 16 and 17.

The men ‘insulted, threatened and sometimes injured’ the policemen as they tried to arrest some of the alleged perpetrators, Bild reported.

Four men, including the two main culprits, were later arrested but three of them have since been released due to ‘lack of grounds for detention’.

They are said to have resisted arrest and became violent with officers.

Businesses in the shopping mall have reported an ‘increasing number of thefts’ and customers being ‘molested’ by migrants.

Several other young girls have told police they were harassed too since the incident received media attention.

Interior Minister Stefan Studt said the incident was ‘unacceptable’ and that Germans ‘need to be able to live freely in this country.’

He warned against drawing comparisons to the mass molestation of women in Cologne on New Year’s Eve.

But FDP leader Wolfgang Kubicki said the newest incident should act as a wake up call that the country’s open border immigration policy was failing.

He called it the ‘opposite of integration’ and an example of how ‘parallel societies’ are being created in Germany as a result of the migrant influx.

Security guards hired to protect Jude Law when he visited the ‘Jungle’ migrant camp were reportedly targeted by rock-pelting migrants just moments after the actor boarded the coach home.

The star made the journey to northern France last week to highlight the plight of child refugees who are being evicted under a move by French authorities to demolish the southern part of the camp.

He was joined by singer Tom Odell and a film crew, who captured him on camera as he urged David Cameron to let the hundreds of children at the camp come to the UK.

But moments after the celebrities had boarded the production team coach back to Britain, their security team was ambushed, according to the Sunday People.

The attackers reportedly hurled stones at the men before stealing their mobile phones.

A source told the newspaper: ‘We were shocked to see some of the migrants acting like football hooligans. The security team had stones thrown at them and two had phones smashed and stolen.’

The official deadline for migrants to leave the most southern part of the camp was on Tuesday and the first phase of clearing migrants started on Thursday after a judge approved mass evictions.

Charities working in the camps say the demolition will destroy the homes of 3,000 people, including hundreds of children.

It will, they claim, ‘uproot again those who have already had to abandon their homes due to war and persecution.’

But opponents point out that many of those living in the Calais jungle are economic migrants simply trying to get into Britain for a better life.

Ministers have resisted calls to take more migrants from the continent – for fear it will encourage others to risk their lives trying to get to Europe.

Mr Law said last week: ‘These are innocent, vulnerable children caught up in red tape with the frightening prospect of the demolition of the Jungle hanging over them.

‘David Cameron and the British Government must urgently work with the French authorities to alleviate this humanitarian crisis.’

The Talented Mr Ripley star appeared at the camp with Toby Jones, who stars in the new Dad’s Army film and veteran playwright Tom Stoppard.

Singer Tom Odell and comedian Shappi Khorsandi were also there.

The group read out letters from famous historical figures in front of 200 people at the campsite in an event organised by Letters Live.

Figures from charity Help Refugees show that there are 440 children living in the southern section of the camp, 291 of whom are unaccompanied. Around 3,700 people in total live in the camp.

Two migrants were arrested for raping a twelve-year-old boy at a housing center for unaccompanied migrants in Sweden. The men said they were 15 but social media shows they were born in 1997 and 1971.

The men raped the child and recorded the attack on a cellphone.

Two migrants accused of raping a 12-year-old refugee at a housing centre for unaccompanied minors in Sweden lied about their age, claiming to be 15.

The men reportedly attacked the boy at the centre in Alvesta, Smaland, and are said to have filmed the sexual assault on a mobile phone.

Despite claiming to be 15 and 16 when applying for asylum in Sweden, the two alleged attackers have now been found to be over 18 after undergoing a dental age assessment, a prosecutor said.

Prosecutor Emma Berge also produced screen grabs of the accused’s Facebook pages where one of them claims to be born in 1997, and the other in 1971.

One of the men also writes on the social network that he has previously worked as a mechanic in Dubai.

Ms Berge says that she is not claiming that the man is 45, but that he is over 18.

‘A dental examination with an age assessment had been made by the National Board of Forensic Medicine, and then there is information from Facebook and similar sources,’ Ms Berhge told Expressen.

‘And then you also have to look at their appearance and how they are perceived.’

The alleged attack took place at a government-provided housing centre for underaged unaccompanied migrants and refugees in Alvesta, Smaland county.

The housing is meant to be for minors in their late teens, but despite the alleged victim only being 12 years old, he was placed at the home.

The alleged rape is said to have taken place outside, near the housing, in the beginning of January, Expressen reports.

The boy is said to have been beaten and then raped, first by one of the men, and then by the other.

The first rape was allegedly filmed by one of the men, and sent over to the second suspect’s mobile phone.

German capital city Berlin has joined the sad parade of cities touched by migrant sex violence on New Year’s Eve, with hundreds of assaults now reported to police in Cologne and other cities.

Although on a smaller scale to the unrestrained and un-policed sex attacks in Cologne, the Berliner Morgenpost has now reported on assaults taking place on the street “in front of the Brandenburg gate”.

The revelation may prove difficult for the German media, which until now has stressed in most reports on the new year’s rapes that Berlin was not caught up in the scandal.

The paper reports four separate incidents around the cite, including a tourist being sexually assaulted by a group of “three to five men”, and two women being “sexually harassed” by men from Pakistan and Iraq.

Another woman came forward to police on Tuesday following national press coverage of the migrant rape scandal to report being “touched” at a music event by “several immoral men”.

More analagous to the Cologne attacks were events in Hamburg, where groups of “southern or Arab appearance” men aged between 20 and 40 sexually assaulted dozens of women.

Police have recieved 53 complaints of harrasment relating to new year’s eve so far, including 39 of sexual harassment. One 19 year old girl identified by the pseudonym of ‘Lotta’ went out to celebrate the new year in a ‘chic’ dress and high heels.

Spiegel reports their comments when they related while walking between two clubs, they were warned by a bouncer not to go down a particular street, to do so “would be your death”. Despite the warning Lotta and her girlfriends walked down the road but became separated by the men. She said: “I was suddenly alone… 20 to 30 men were standing around me… every time a hand went away, already arrived the next… I felt helpless”.

Having been assaulted under her dress, her hair pulled, and finally thrown to the ground, Lotta met up with her friends, who had all been treated similarly by other groups of men. The girl told Spiegel she thought they were “foreign origin”.

In Stuttgart two 18 year old women were assaulted and robbed by a gang of 15 men reports the Stuttgarter Zeitung, as well as an unspecified number of other “mostly young women” victims. The state prosecutor warned against making comparisons between Stuttgart and Cologne, remarkng “The incidents in both cities vary greatly in their dimensions”.

Düsseldorf saw at least eleven sexual assaults in the historic city centre by “North African” men. In contrast to Stuttgart a police source here was less reticent to admit the scale of the problem, admitting “The nature of the offenses with which is comparable in Cologne”.
