A Fulton nurse convicted of taking a photo of an unconscious patient’s penis with her iPhone last year surrendered her license, according to the New York State Education Department.

Kristen Johnson was forced to give up her license as part of a plea deal where she pleaded guilty to misdemeanor disseminating of unlawful surveillance photos.

Her conviction came after a nine-month investigation by the Onondaga County District Attorney’s Office into complaints from her Upstate University Hospital co-workers that she sent pictures of two patients via text message.

She was originally charged with two counts of second-degree unlawful surveillance and one count of second-degree disseminating unlawful surveillance.

The felony charge against her was reduced as part of her plea, which also requires Johnson to spend three years on probation.

According to the state, Johnson surrendered her license and did not contest the charge of moral unfitness in the practice.

Fox News host Bill O’Reilly has lost custody of his two teenage children after they reportedly said they would prefer to live with their mother following an alleged domestic violence incident, according to court documents.

As reported by Gawker, Mr O’Reilly’s two children, 13 and 17, will live full time with his ex-wife Maureen McPhilmy.

The decision taken by a Nassau County Supreme Court justice last year that the children should live with their mother was appealed by the news host to delay its enforcement.

According to the 1,400 word opinion issued on 24 February, the court’s four justices unanimously ruled in his ex-wife’s favour based upon “the clearly stated preferences of the children” and the “quality of the home environment provided by the mother”.

Mr O’Reilly’s 17-year-old daughter told a court-appointed forensic examiner last year that she saw her father dragging her mother down a staircase by the neck.

He responded to Politico in May last year: “All allegations against me in these circumstances are 100% false. I am going to respect the court-mandated confidentiality put in place to protect my children and will not comment any further.”

Court transcripts seen by Gawker allegedly revealed that his daughter also considered Mr O’Reilly as an absentee parent who was not interested in developing a relationship with her and struggled to control his rage, which she found “scary”.

He also allegedly told his daughter that her mother was an “adulterer”.

The court decided that the parents would share custody over issues like which schools the children should attend, which medical care they receive and the religion they practise – he has strong connections with the Catholic Church. Mr O’Reilly had previously insisted he had sole legal custody for those matters.

A court docket shown by Gawker suggests that Mr O’Reilly is still fighting against the verdict and is pursuing contempt of court charges against his ex-wife. It is not known why he believes Ms McPhilmy has violated the court’s instructions.

Mr O’Reilly was accused of sexual harassment in 2004 by former Fox News producer Andrea Mackris – he allegedly bragged about attending a sex show in Thailand and insisted that she masturbate over the phone with a vibrator. Mr O’Reilly reached an out-of-court settlement with Ms Mackris.

The San Francisco sheriff who over the summer became embroiled in a national debate over “sanctuary city” policies on Tuesday lost his bid for re-election amid a host of local controversies.

Sheriff Ross Mirkarimi, 54, was defeated by Vicki Hennessy, a former sheriff’s official who had the endorsement of San Francisco Mayor Ed Lee and the sheriff deputies association. As of early Wednesday morning, Hennessy had received 62 percent of the vote to just 31 percent for Mirkarimi.

Mirkarimi was the subject of national criticism after Mexican illegal immigrant Francisco Sanchez allegedly shot and killed 32-year-old Kate Steinle on San Francisco’s waterfront July 1. Sanchez had been released from Mirkarimi’s jail in March even though federal immigration officials had requested he be detained for possible deportation.

But since then, the sheriff’s oversight of the department has been plagued by other high-profile mishaps and controversies seen as contributing to his defeat. He had his driver’s license briefly suspended for failing to properly report a minor accident while driving a department-issued car, and he also flunked a marksmanship test.

Before those two incidents, a drug gang leader escaped from jail, and guards were accused of staging and gambling on inmate fights.

In November 2014, Mirkarimi also was forced to apologize for the bungled search for a San Francisco General Hospital patient whose body was found in a stairwell weeks after she wandered from her room. The sheriff is in charge of the hospital’s security, but deputies didn’t search the building until nine days after her disappearance. The city paid the patient’s family $3 million to settle a lawsuit.

But Mirkarimi is now known nationally for his strident defense of sanctuary city policies, taking the practice to a new level under his leadership.

San Francisco declared itself a sanctuary city in 1989, passing an ordinance that bans city officials from enforcing immigration laws or asking about immigration status unless required by law or court order. A follow-up ordinance in 2013 allows detention only under a court order targeting violent felons. Last month, San Francisco’s board of supervisors unanimously approved a resolution to maintain the city’s sanctuary status.

San Francisco and other cities and counties have routinely ignored requests from Immigration and Customs Enforcement officials to keep people in custody. The jurisdictions say they can’t hold arrestees beyond their scheduled release dates without probable cause.

Hennessy has previously said the sheriff’s order barring the San Francisco jail from cooperating with immigration officials is misguided. There are cases, she said, when federal immigration officials should be notified that the jail is about to release an inmate who is in the country illegally.

San Diego voters opted for a return to Republican leadership on Tuesday as they elected a city councilman backed by the downtown establishment to succeed ex-Mayor Bob Filner, a Democrat who resigned amid a torrent of sexual misconduct allegations.

Republican Kevin Faulconer garnered nearly 55 percent of the vote to defeat his City Council colleague, Democrat David Alvarez, who was vying to become San Diego’s first Hispanic mayor but finished the night with just over 45 percent.

Faulconer, 47, declaring victory at a downtown hotel, is expected to take the oath of office in early March to serve out the nearly three years that remained in Filner’s term as mayor of California’s second-most populous city.

Defense Department Loses At Least $1.1 Billion To Waste And Fraud In One Year

DOD Makes $1.1 Bil In “Erroneous Payments” In One Year – Judicial Watch

Though it may seem inconceivable to the taxpayers that fund this atrocity, a major government agency with a monstrous annual budget loses such large sums of money to waste and fraud each year that it has no idea how much and nothing has been done to stop the hemorrhaging.

What we do know, thanks to a federal audit released this month, is that the amount of public funds lost to waste and fraud amounted to at least $1.1 billion in one recent year alone though it’s likely much higher. The actual figure will never be pinned down because financial management shortcomings at the agency, the Department of Defense (DOD), are too severe.

The estimates “were neither reliable nor statistically valid because of long-standing and pervasive financial management weaknesses and significant deficiencies in the department’s procedures to estimate improper payments,” according to the audit. This means that, unbelievably, the enormous $1.1 billion waste figure listed in the report for fiscal year 2011 isn’t even credible due to “missing invoices and other flawed paperwork, as well as errors in arithmetic.”

Imagine if a private business, or even a household for that matter, was run in this manner. But this is the Pentagon and it has a never-ending cash flow that allows it to spend about a trillion dollars annually like it’s no big deal. The $1.1 billion in “erroneous payments” that year went to a variety of things, including overpayments of military health benefits, civilian, travel and commercial pay to vendors. It’s like a free for all, with large wads of cash distributed everywhere and little to no oversight.

The DOD doesn’t seem terribly worried about it and appears to have no sense of urgency to correct the problem. Investigators from the Government Accountability Office (GAO), the investigative arm of Congress, found that the DOD hasn’t bothered performing a required risk assessment to identify programs susceptible to significant improper payments or that the agency has implemented procedures to identify root causes of improper payments. Furthermore, the Pentagon hasn’t conducted recovery audits for any of its wasteful programs.

You can’t help but get the feeling that the DOD simply doesn’t care about correcting this rather large problem, which has been documented over two decades in a variety of federal probes. Just a few months ago the DOD Inspector General revealed that a company that had “overbilled” the Pentagon an astounding $757 million was rewarded with a monstrous no-bid contract extension worth more than $4 billion. A Florida lawmaker, John Mica, investigating the matter offered this assessment during a congressional hearing: “This has to be one of the prime poster childs for a government contract spun out of control.”

Prior this that the DOD has been under fire for wasting large sums of money, including $70 billion on dubious projects unrelated to its mission. This includes billions on research that has little or nothing to do with national defense or medical needs related to military service, including $5.2 billion to study fish that overcome political polarization and $1.4 million to create beef jerky treats. You can’t make this stuff up!

Who could forget the billions wasted in Iraq reconstruction efforts? Audit after audit has exposed how the DOD projects are rife with waste, fraud and abuse and that the spending is so out of control the government has lost track of a large portion of the money. At last count at least $6 to $8 billion earmarked to rebuild Iraq by training local police, building schools, hospitals and transportation systems could not even be accounted for.

On the heels of that unbelievable revelation Americans learned that the Pentagon had somehow lost $475 million worth of oil destined for the Afghan National Army. It simply vanished with no trace. It’s unlikely we will ever know how the oil disappeared because the DOD improperly shredded records that could solve the mystery, according to federal auditors.
