Administration Eases Visa Rules For Travelers Visiting Terror Hotspots – Fox News

The Obama administration on Thursday eased visa rules for certain European travelers who have visited terror hotspots in the Middle East and Africa, a move certain to rile congressional lawmakers who sought the restrictions.

The revised requirements announced Thursday pertain to changes in the Visa Waiver Program passed by Congress. Lawmakers had sought new restrictions to tighten up the program – which allows visa-free travel for residents of eligible countries – in order to prevent Europeans who have joined ISIS from entering the U.S.

The administration implemented the changes Thursday – but with some changes of its own.

As called for by The Visa Waiver Improvement and Terrorist Travel Prevention Act of 2015, the administration is mostly excluding nationals of Iraq, Iran, Syria and Sudan as well as travelers who have visited the countries since Mar. 1, 2011 from the program. Instead, they’ll have to apply for a visa in order to travel to the United States.

But under the revised requirements, some Europeans who have traveled to those four countries in the last five years may still be allowed to travel to the United States without obtaining a visa if they meet certain criteria.

The administration announced Thursday that it will use its waiver authority – granted to it in the legislation – to give waivers to travelers who traveled to the terror hotspots as journalists, for work with humanitarian agencies or on behalf of international organizations, regional organizations and sub-national governments on official duty.

Likely to cause ire among congressional Republicans is an additional waiver for people who have traveled to Iran “for legitimate business-related purposes” since the conclusion of the Iran nuclear deal in July. The administration also offers waivers for individuals who have traveled to Iraq for business as well.

Citizens of 38 countries, mostly in Europe, are generally allowed to travel to the United States without applying for a visa. But they still have to submit biographical information to the Electronic System for Travel Authorization, or ESTA.

The Homeland Security Department said waivers for some ESTA applicants will be granted on a “case-by-case” basis. Those travelers who are denied visa-free travel can still apply for visa through a U.S. embassy in their home country.

Republicans reacted angrily to the waivers, saying the Obama administration had exploited the limited authority and has compromised national security.

“President Obama and his administration’s decision to abuse their limited waiver authority and allow scores of people who have traveled to or are dual nationals of countries like Iraq and Syria flies in the face of reason and congressional intent,” House Judiciary Committee Chairman Bob Goodlatte, R-Va., said in a statement.

“The Obama Administration is essentially rewriting the law by blowing wide open a small window of discretion that Congress gave it for law enforcement and national security reasons,” Goodlatte said.

The new restrictions had previously been criticized by the Iranian government that the U.S. is violating the nuclear deal by penalizing legitimate business travel to the country.

A gunman ambushed 33-year old Philadelphia police officer Jesse Hartnett on Thursday night. His attacker is in custody and claims it was an attempted “execution” in the name of Islam.

CBS News in Philadelphia reports Hartnett was sitting in his patrol car at around 11:30 PM when the attacker fired 13 shots through the driver’s side window at point-blank range. The CBS report describes the shooter as walking toward the police car while he fired. Three of the shots struck Hartnett’s arm. His injuries do not appear to be life-threatening.

“Shots fired! I’m shot! I’m bleeding heavily!” Hartnett called out on police radio, as can be heard in the CBS report:

Hartnett was able to return fire, and hit the as-yet unnamed suspect three times. Other offices swiftly caught the wounded assailant while attempting to flee the scene, and he has made a full confession, according to CBS. The confession reportedly describes Islam as part of the motive for the attack.

Police also recovered his weapon. The New York Daily News identifies it as a 9mm handgun.

Commissioner Ross said there is video of the entire attack. “This is absolutely one of the scariest things I’ve ever seen,” he declared. “I mean, this guy tried to execute the police officer. The officer had no idea he was coming. It’s amazing he’s alive.”

The shooter is described as a male in his 30s. According to a news description of the surveillance video, he was wearing a “long white frock and black pants” as he approached the police cruiser with his gun drawn. The current condition of the shooter has not been disclosed at the time of this writing.

Ross said Hartnett suffered “significant damage” to his arm, including nerve damage, but is awake and coherent. According to the New York Daily News, he underwent surgery early Friday at Presbyterian Hospital and is expected to make a full recovery.

NJ.com cites Officer Hartnett’s social media profiles to describe him as a native of East Landsdowne, Pennsylvania, who attended Delaware County Community College, served in the U.S. Coast Guard for over a decade, and then became a four-year veteran of the police force.

CBS News reported late Friday morning that the FBI has become involved in the investigation.

Update, 11:15 AM EST: Philly.com reports the shooter has been identified as Edward Archer, 30, of Yeadon.

Update, 1:15 PM: According to Commissioner Ross, the attacker pledged allegiance to the Islamic State.

Also, the gun used in the attack was reportedly stolen, which will be bad news for those who were frantically looking for a way to fold the incident into their gun-control narratives.

Update, 1:45 PM: Philly.com has some more details about Edward Archer, courtesy of his mother:

Reached at her home in Lansdowne, his mother, Valerie Holliday, said Archer was the eldest of seven children and suffered head injuries from playing football and a moped accident.

“He’s been acting kind of strange lately. He’s been talking to himself… laughing and mumbling,” Holliday said. “He’s been hearing voices in his head. We asked him to get medical help.”

She said her son is devout Muslim who has practiced the faith “for a long time.”

“He’s going through a lot lately,” Holliday said, adding Archer believed he was targeted by police.

There are some good reasons the police might have “targeted” Edward:

Archer was scheduled to be sentenced Monday in a Delaware County case, according to court records. He was found guilty in a November nonjury trial of forging documents, careless driving, driving with a suspended or revoked license and other related offenses.

In Philadelphia, he was sentenced in March to nine to 23 months in jail and two years probation in an assault case. He was charged with aggravated assault, conspiracy, firearms offenses and terroristic threats for a January 2012 incident but pleaded guilty to simple assault.

Here’s a thought: maybe we should put more effort into enforcing existing laws, rather than passing a boatload of new ones. Of course, the existing laws involve difficult duties such as catching and imprisoning violent criminals, and protecting the nation from terrorist threats – both of which are pursuits that often infuriate the cult of political correctness.

It’s much easier to pass new laws that either do nothing of substance, or involve pushing around decent law-abiding taxpayers. Telling a rape victim she shouldn’t have a gun to defend herself is far easier than keeping someone imprisoned for assault.

Philly.com also tells us a bit more about the wounded Officer Jesse Hartnett, hailed as a “true hero” by fellow officers. He actually got out of his car and pursued the suspect on foot, after getting sprayed with 13 bullets and taking three hits in the arm. His father Robert described Hartnett as “a very quality young man.” On that, I think we can all agree.

On Wednesday, CNN reported that Usaamah Rahim, the terror suspect fatally shot by police after waving a knife at officers in Boston, originally plotted to behead Pamela Geller, the organizer of the Garland free-speech event targeted by two Islamic gunmen. Meanwhile, Ferguson #BlackLivesMatter protesters are set to hold a rally for Rahim this Friday at the Ferguson Police Department.

The Facebook event page appears to have been hacked, but the description remains intact as of this writing. “#BlackLivesMatter Protest police Murder and Profiling of our Black brothers. We must stand strong and resist tyrant pigs and feds who killed Usaama Rahim. Invite your Family and Friends and lets take our streets back,” the page says.

“It’s our duty to tell the evil government we won’t put up with it any longer,” the event says. “Heads will roll,” the statement ironically adds.

Court documents indicate that Rahim changed his mind and decided to attack police officers instead. “I can’t wait that long,” he reportedly said of the original plan. Officials said they believe Rahim was radicalized by ISIS and other extremists, CNN added.

Geller, the target of death threats, responded sharply on her blog. “They mean to kill everyone who doesn’t do their bidding and abide by then voluntarily,” she wrote. “This is a showdown for American freedom. Will we stand against this savagery, or bow down to them and silence ourselves? ”

Geller told CNN she’s had an “army of security” since the Garland attack. “This is what is required just to show a cartoon in America, 2015,” she added. “It’s striking. It’s devastating, and people need to understand what’s at stake. I mean, if we surrender on this point, what will we surrender next?”

Rahim’s brother, Ibrahim, claimed on social media that Usaamah was shot three times in the back. Police, however, say the incident was recorded on surveillance video. They also decided to show it to community leaders, including Muslim leaders, NBC News said, in the interest of transparency.

“Darnell Williams, head of the Urban League of Eastern Massachusetts, said the video ‘150 percent’ corroborates the police account,” NBC added. Abdullah Faaruuq, imam of Boston’s Mosque for the Praising of Allah, called the video’s images,”vague,” but admitted that Rahim did not appear to obey officers’ commands. But, he added, “we’re not satisfied until [the case is] fully vetted.”

It’s uncertain how many people will actually appear at the protest. As of Wednesday evening, only two supporters said they would attend, but that could be a result of the event being hacked.
