Amnesty Granted To Child Molesting Camp Counselor Known As ‘Papa Bear’ – Daily Caller

The Department of Homeland Security (DHS) knew last year that an illegal alien California camp counselor known as “Papa Bear” was being investigated on child molestation and child pornography charges but did nothing about it, Iowa U.S. Sen. Chuck Grassley claims in a letter sent to DHS Sec. Jeh Johnson on Wednesday.

Edgar Covarrubias-Padilla was arrested May 7 and charged with four felonies including child molestation and the distribution of child pornography. According to local news reports, authorities believe that Covarrubias-Padilla also produced child pornography.

Covarrubias-Padilla recently worked as a night counselor at Walden West, an environmental science camp near San Jose. Besides the recovery of 600 child porn images from his computer, Covarrubias-Padilla has been accused of sexually abusing a 10-year-old boy. The Santa Clara County Office of Education told Grassley’s office that it had received over 100 phone calls and 50 emails from parents concerned that their child may have been victimized. Covarrubias-Padilla worked at two other camps over the past two years.

In his letter to Johnson, Grassley stated that whistleblowers with U.S. Immigration and Customs Enforcement (ICE) — a DHS sub-agency — claim that the federal authorities knew as early as Nov. 17 that Covarrubias-Padilla was being investigated for child sex abuse charges.

Yet, nothing was done about his DACA status until his recent arrest, Grassley claims.

The whistleblowers claim that on Oct. 8, 2012, Covarrubias-Padilla applied for amnesty protection under President Obama’s Deferred Action for Childhood Arrivals (DACA) program. His amnesty and work eligibility were scheduled to last through this month, at which point he would have been allowed to re-apply for the program.

“These allegations are deeply troubling because, if true, they suggest that DHS was aware for months or years that Mr. Covarrubias-Padilla posed a public safety threat to the children he was monitoring, yet took no action to revoke his DACA authorization,” Grassley, a Republican, wrote to Johnson.

“These allegations are particularly alarming because they suggest that Mr. Covarrubias-Padilla would not have been placed in a position to abuse and exploit children had DHS properly vetted DACA recipients,” Grassley added.

Grassley has recently shed light on other cases involving felonious DACA recipients. One particular egregious case of DHS failure was Emmanuel Jesus Rangel-Hernandez. Rangel-Hernandez was slated for deportation following a 2012 marijuana charge. He applied for amnesty under DACA in Feb. 2013, and his application was approved in Aug. 2013. But the application was approved even though U.S. Customs and Immigration Services (USCIS) was aware that Rangel-Hernandez was gang-affiliated. Gang members are not eligible for DACA status.

After Grassley raised questions about Rangel-Hernandez’s case, USCIS admitted in a response letter that it erred in approving his DACA application and ensured that steps were taken to prevent gang members from being given amnesty in the future.

In his latest letter to Johnson, Grassley asked 11 questions about Covarrubias-Padilla’s DACA application, immigration status, and known criminal history.

He asked for a response by May 29.

Grassley also sought information on how ICE and USCIS coordinated and shared information about Covarrubias-Padilla.

“Did USCIS know or have reason to know that ICE was investigating Edgar Covarrubias-Padilla in connection to crimes involving either possession or distribution of child pornography or child exploitation, including molestation?” Grassley asked.

“If Edgar Covarrubias-Padilla was under investigation by ICE, please provide the procedures in place for when, and in what manner, ICE would have notified USCIS.”

San Francisco Gay Icon Found Guilty Of Felony Child Pornography Possession

Larry Brinkin, who worked at the Human Rights Commission for the City of San Francisco for 22 years and was a prominent homosexual rights activist for more than 40 years, pleaded guilty to felony child pornography possession last week.

Brinkin is expected to serve six months in jail, five years of probation, and register as a sex offender for the rest of his life when he is sentenced on Mar. 5. But he likely will get to keep his city pension because possessing and viewing child porn apparently is not considered a crime of “moral turpitude” under San Francisco’s retirement/pension rules.

According to police, as reported by the San Francisco Chronicle and SF Weekly, Brinkin had photographic images of children between the ages of 1 and 3 who were being sodomized and forced to perform oral sex on adult men.

Also, in e-mails attributed to Brinkin using the account “Zack3737@aol.com,” he praised interracial adult-child sex saying, in one message, “I loved especially the [N-word] 2 year old getting nailed. Hope you’ll continue so I can see what the little blond bitch is going to get. White Power! White Supremacy! White D— Rules!”

Brinkin, who is “married” to partner Wood Massi and has a son with two mothers, retired from the city’s Human Rights Commission in 2010, when he was 64 years old. At the time and with the support of city official Bevan Dufty, the San Francisco Board of Supervisors, in honor of Brinkin’s work over the years to combat discrimination, passed a resolution declaring the first seven days of February 2010 “Larry Brinkin Week.”

While on the Human Rights Commission, Brinkin had worked as a compliance officer, responsible for helping to ensure non-discrimination against employees. He had been instrumental, back in 1982, in implementing San Francisco’s Equal Benefits Ordinance, which required employers to provide equal coverage for “domestic partners.” Further, Brinkin has been a long-time advocate for gay “marriage.”

The archived pages of SF Pride say of Brinkin, “Larry Brinkin has been an activist in San Francisco for over 35 years, co-founding Bay Area Gay Liberation, the Lesbian/Gay Labor Alliance, and the Gay & Lesbian Alternative Dispute Resolution Service. He was a pioneer in the struggle for domestic partner benefits and currently is the manager of the LGBT&HIV Division of the SF Human Rights Commission. He played a major role in recent years in the struggle for transgender rights.”

Brinkin was first arrested in the child pornography investigation in June 2012. According to the news reports, in early 2012 America Online (AOL) had contacted authorities after discovering e-mails and child pornographic images in one of the company’s subscriber accounts.

The Los Angeles Police Department, then put in charge of the case, traced the IP address of the e-mail account Zack3737@aol.com to Larry Brinkin. Police then confirmed that Brinkin had paid for the e-mail service with his credit card.

At that point, the San Francisco Police Department was informed of the case and carried on the investigation.

As the San Francisco Chronicle reported in June 2012, “Police say that Brinkin had pornographic images, some that appear to show children as young as 1 and 2 or 3 years old being sodomized and performing oral sex on adult men, in e-mail attachments linked to his account, according to a search warrant served by San Francisco police.”

“Police provided two examples of e-mail messages from last year in which Zack3737 provides disturbing descriptions of the exploitative sexual acts,” reported The Chronicle. “The e-mail account also is linked to Yahoo discussion groups on sexual exploitation of young boys and girls, according to the search warrant.”

“Investigators say they additionally found e-mails sent from Brinkin’s now-defunct city e-mail account to Zack373@aol.com,” reported SF Weekly.

Later, on Sept. 26, 2012, San Francisco District Attorney George Gascon officially charged Brinkin “with 2 counts of distributing child pornography and 4 counts of possessing child pornography,” reads a press release. “The defendant allegedly received and sent emails containing pornographic images of children.”

The district attorney’s press release further says, “Investigators determined the defendant received e-mails and sent two reply emails containing the child pornography. On June 22, the San Francisco Police Department seized computers belonging to the defendant containing dozens of images of child pornography.”

Like the e-mail already mentioned, the Bay Area Reporter noted that police cited in court records another e-mail comment about a child porn image where Brinkin boasted about a 2-to-3-year-old caucasian child being sodomized by a black adult male.

After Brinkin’s initial arrest, Theresa Sparks, executive director of San Francisco’s Human Rights Commission, told the media, “It’s almost incredulous, there’s no way I could believe such a thing. He’s always been one of my heroes, and he’s the epitome of human rights activist – this is the man who coined phrases we use in our daily language. I support Larry 100%. Hopefully, it will all come out in the investigation.”

Bevan Dufty, who served on the San Francisco Board of Supervisors and now is director of Housing Opportunity, Partnerships and Engagement in the mayor’s office, following Brinkin’s arrest said, “I have admired and respected his work for the LGBT community. I respect and am confident that there will be due process.”

Several e-mail and telephone inquiries from CNSNews.com to Dufty, the San Francisco Board of Supervisors, the San Francisco Human Rights Commission (HRC), and its media relations contact, David Miree, for comment on Larry Brinkin’s guilty plea were not answered before this story was posted.

HRC Executive Director Theresa Sparks did speak with the Bay Area Reporter, however, saying, “Overall, I have no comment, obviously, professionally. But personally I think it’s just a very, very sad commentary, a very sad situation. I’m heartbroken it happened.”

Brinkin had worked at the Human Rights Commission for 22 years and retired in 2010, when he was making a salary of $135,000, according to SF Weekly.

Concerning whether Brinkin will retain his city pension, his attorney Randall Knox said he did not think the felony child porn possession conviction was relevant because it apparently does not fall under “moral turpitude,” as explained in the city rule Proposition C.

“This is not a moral turpitude crime,” Knox told the Bay Area Reporter, and it is “not something that happened when he was working for the city.”

Under that law, approved in 2008, a city employee who commits a crime involving “moral turpitude” cannot collect retirement benefits from the city.

In a June 2008 voter guide released by SPUR, a non-profit group that focuses on urban policy in San Francisco, it explains Proposition C- Moral Turpitude as follows, “As applied to crimes that might be committed in connection with employment with the City, moral turpitude often involves some kind of theft of public property, including materials and services.

“Proposition C is an amendment to the San Francisco City Charter that would prevent retired City employees who are convicted of crimes of moral turpitude from receiving the City-funded portion of their pension, if the crimes were committed ‘in connection with their employment.’”

Brinkin pleaded guilty in his plea deal on Jan. 21. He is scheduled to be sentenced on Mar. 5. The plea deal reduced the six felony child pornography charges to one felony count of possessing child porn.

In addition to the six months’ incarceration, home detention, probation, and registering as a sex offender for life, Brinkin will also have to undergo sex offender therapy, “and is banned from working with kids, contacting a juvenile without parental consent, and living with someone responsible for a child without disclosing his offender status,” reported the San Francisco Chronicle.

Common Core Education has sparked political controversy since the U.S. Department of Education decided to adopt its curriculum nationwide in both public and private schools. The Common Core website lists “exemplar texts” by grade which they recommend for reading and one in particular has some parents taking action. The Common Core recommends a book for 11th and 12th graders by Nobel Prize winning author Toni Morrison called “The Bluest Eye”. The excerpts from the book are too pornographic to post here but you can choose to read them here at this link. The Bluest Eye depicts detailed accounts of incest, rape and pedophilia as “friendly”, “innocent” and “tender”. The biggest issue with the book is that the story is told from the pedophile’s point of view so the reader can become a “co-conspirator” with the rapist. The author purposely did not portray the pedophile’s actions as wrong so the reader can “sympathize” with the pedophile.

Obviously the reason behind some parents calls for removing the book are the graphic depictions of incest, rape and pedophilia. And not just that, the book actually lets the reader see the depictions from the perpetrators point of view. In fact, the author of the book, Morrison, says that she wanted the reader to feel as though they are a “co-conspirator” with the rapist. She took pains to make sure she never portrayed the actions as wrong in order to show how everyone has their own problems. She even goes as far as to describe the pedophilia, rape and incest “friendly,” “innocent,” and “tender.”

It’s no wonder that this book is in the top 10 list of most contested books in the country. The Bluest Eye is the story of Pecola Breedlove, a young black girl, who prays every day for beauty: for the blond hair and blue eyes that she believes will allow her to fit in. As her life begins to disintegrate in the face of adversity and strife, such as being raped by her father and beaten by her mother, she finally appeals to Soaphead Church, a pedophile, to help her attain blue eyes. After being impregnated by her father, she loses her baby and ultimately loses her mind.

Macey France goes on to explain why this is no different than child pornography:

Using just the smallest amount of common sense we can deduce that if the book cannot be read aloud in the class, could not be viewable if it was a movie and couldn’t be played on the stereo if it was a CD, then why is it okay for it to be read and discussed; in school of all places! In fact, according to one lawyer, if the incidents in this book were a movie or a picture there would be a very clear cut case for prosecution for child pornography.

Jay Riley, a 21-year-old Virginia man, was jailed last Tuesday after he allegedly brought his computer to a police station, and asked officers if they wanted to arrest him on child pornography charges.

According to Prince William County Police, Riley was surfing porn sites on his computer last week when an “FBI Warning Message” popped up on his screen.

Investigators say the message told Riley that he needed to pay a fine or be subject to a child pornography criminal investigation.

Taking the message seriously, Riley packed up his computer, headed down to his local police station and asked officers if there were any child porn warrants for his arrest.

Officers searched Riley’s computer and found several inappropriate photographs and chat log messages Riley had exchanged with a 13-year-old girl from Minnesota.

Armed with a search warrant, detectives seized a computer and several other electronic devices from Riley’s home.

Riley was booked into jail and charged with 3 counts of possessing child pornography, 1 count of using a communication device to solicit certain offenses involving children and 1 count of indecent liberties with a minor.

The message that prompted Riley to go to a police station was later determined to be a virus that had been downloaded to his computer.

Sen. Charles Grassley, R-Iowa, questioned the Justice Department Thursday on why it declined to prosecute an unnamed Assistant U.S. Attorney after the department’s Inspector General (IG) found child pornography on the Attorney’s work computer.

According to the IG’s report, the Assistant U.S. Attorney acknowledged he spent a significant amount of time each day viewing pornography during work hours. The report also cited that at least one image depicting child pornography was recovered on the attorney’s government computer.

The U.S. Attorney’s office declined to prosecute the case. As of May 31, 2011, disciplinary action against the attorney was still pending, according to the report.

“As the case for disciplinary action is ‘pending’ as of May 31, 2011, this means that, at the very least, the Department of Justice has allowed an admitted serial viewer of pornography – possibly child pornography – to serve as an Assistant United States Attorney for two months, if not longer, and has yet to take action,” Grassley said in a letter to Attorney General Eric Holder on July 7.

In 2010, Grassley learned that 33 employees at the Securities and Exchange Commission who were found to have viewed pornography during work hours were not terminated and were given uneven and light disciplinary action.

A passenger screener at Philadelphia International Airport is facing charges that he distributed more than 100 images of child pornography via Facebook, records show.

Federal agents also allege that Transportation Safety Administration Officer Thomas Gordon Jr. of Philadelphia, who routinely searched airline passengers, uploaded explicit pictures of young girls to an Internet site on which he also posted a photograph of himself in his TSA uniform.

Homeland Security agents arrested the TSA officer March 24, and he is being held without bail.

Although the case was unsealed Thursday, neither the indictment nor the news release mentioned Gordon’s job searching airline passengers for TSA.

The arrest comes as TSA grapples with several other incidents involving screeners, including a YouTube video posted last week by parents angry about the pat-down their 6-year-old daughter received at an airport in New Orleans. TSA officials said the pat-down was proper; the parents said the girl was “groped.”

Citing privacy rules, TSA spokeswoman Ann Davis would not say if Gordon has been suspended from his job, but noted that he had been in federal custody since his arrest.

“We can assure the public that he is no longer working at the airport,” Davis said.

Gordon began working as a TSA screener at the Philadelphia airport in December 2005, Davis said. The airport has 900 screeners, she said.

If convicted of the child pornography charges, Gordon, 46, faces a minimum mandatory sentence of five years. The maximum prison term is 250 years and the top fine is $3.2 million.

Gordon is paid $37,000 annually as a TSA screener, records show. He has no prior criminal record, officials said.

Assistant U.S. Attorney Michael Levy, chief of his office’s child exploitation unit, declined to comment Friday.

Gordon’s lawyer, Elizabeth Toplin, an assistant federal public defender, could not be reached for comment via e-mail or phone late Friday.

Tipped by the Delaware County District Attorney’s Office, federal agents began investigating Gordon on March 10, according to an affidavit from a Homeland Security Investigations agent.

The tip allegedly included evidence that Gordon had uploaded five explicit photographs of young girls onto the web site Photobucket.

The federal agent alleged that Gordon’s Photobucket account also included a picture of him wearing his blue TSA uniform.

The indictment alleges that Gordon used at least six Facebook accounts and employed multiple names “to upload and store images of sexual exploitation of minor children.”

The charges detail 104 illicit photographs allegedly uploaded over four weeks in February.

Authorities also seized from Gordon an HP laptop and a four-gigabyte flash drive that they say contained more than 600 images or movies containing child pornography, according to court filings.

Gordon’s job as a TSA screener was in jeopardy last year for unrelated reasons, according to an online newsletter of the American Federation of Government Employees.

Citing a family issue, it said Gordon was having “difficulty maintaining his work schedule.” The union lawyer helped convince TSA officials that a change in shift schedule resolved the problem, the newsletter said, and Gordon returned to work.
