Flavored E-cigarettes Are Officially Illegal In New York – New York Post

Flavored e-cigarette products are officially illegal in New York – at least for the next 90 days, state health officials voted late Tuesday.

Following an emergency executive action from Gov. Andrew Cuomo to ban all flavored vape products besides menthol on Sunday, the Public Health and Health Planning Council voted unanimously to implement the move just after 5 p.m.

New York vape shops and bodegas have a two-week grace period before enforcement begins, state health officials said. They’ve been instructed to clean up their shops and remove all of the offending flavored items off the shelves during that time.

If shop owners are caught with any flavored e-liquids, they’ll be fined $2,000 per unit, the Department of Health said in a press release. Once the 90-day period is over, the council will have to reconvene and vote again to extend it another 90 days. If they don’t, the order will expire.

Cuomo wants the state legislature to draft a law that would make the ban permanent…

President Trump Says He Will ‘Substantially Increase’ Iran Sanctions Over Attack On Saudi Arabia Oil Facilities – USA Today

President Donald Trump said Wednesday he is hitting Iran with new economic sanctions over an attack on Saudi Arabia oil facilities.

“I have just instructed the Secretary of the Treasury to substantially increase Sanctions on the country of Iran!” Trump tweeted. He did not specify what those sanctions would be.

Trump made the announcement as his administration considers a variety of responses, both economic and military, to what it calls Iran’s involvement in last weekend’s attack on a Saudi oil production. Iran denies the attack, and accuses the United States of warmongering.

Secretary of State Mike Pompeo is scheduled to be in Saudi Arabia on Wednesday to speak with leaders there about potential responses to the oil facility attack. Pompeo has blamed Iran for Saturday’s strikes on the Abqaiq oil processing plant and a key Saudi oil field, where an estimated 5.7 million barrels of oil are produced each day. Two artists cannot be forced by the state to create custom invitations for same-sex weddings, the Arizona Supreme Court ruled Monday, saying it would run afoul of their Constitutional rights.

North Carolina High School Teacher: VP Mike Pence Should Be “Shot In The Head” – Big League Politics

A North Carolina teacher has become the target of a Secret Service investigation after telling some of their students that Vice President Mike Pence should be “shot in the head.”

The teacher, who works at Cuthbertson High School in Union County, hasn’t been named by school officials. But they’ve been placed under official investigation for their comments.

Vice President Pence had been in the area to campaign for congressional candidate Dan Bishop, who has since triumphed in a contentious special election against a Democrat.

Adult Son Threatens Mass Shooting To Avoid Going To State Fair With Parents, Police Say – Crime Online

A California man allegedly threatened a mass shooting at a state fair on Friday to get out of going to the event with his parents.

The Ponoma Police Department wrote in an alert that Erik Villasenor, 22, sent the threat to the Los Angeles County Fair via email. Police said investigators traced the email to Villasenor, resulting in him confessing to the crime and being charged with making false threats.

“Hello, I was told that someone was planning on doing a mass shooting on Sunday at the Fairgrounds. I just wanted to inform you guys already,’” police chief Mike Olivieri said, paraphrasing the hoax email Villasenor allegedly sent, according to KNBC.

The chief said that Villasenor hoped the hoax email would garner media attention so that he could use it as an excuse to avoid going to the fair with his parents.

In addition to criminal charges, authorities said they’ll be seeking reimbursement for the resources they used to investigate Friday’s hoax threat…

The United Auto Workers voted Sunday morning to strike against General Motors Co. after contract negotiations broke down.

The union advised 46,000 members to strike at 31 General Motors plants at about midnight Sunday, The Wall Street Journal reported. This move followed the collapse of negotiations for a new four-year labor contract.

The union voted for the first national strike since 2007 against the Detroit carmaker after the company has announced plans to shut down four factories, The Associated Press reported.

Trump Authorizes Use Of Emergency Oil Reserve After Saudi Attacks – The Hill

President Trump on Sunday announced he had authorized the use of the U.S.’s emergency oil reserve in response to a series of drone attacks in Saudi Arabia that have disrupted the Gulf country’s crude output.

“Based on the attack on Saudi Arabia, which may have an impact on oil prices, I have authorized the release of oil from the Strategic Petroleum Reserve, if needed, in a to-be-determined amount sufficient to keep the markets well-supplied,” Trump said in a series of tweets. “I have also informed all appropriate agencies to expedite approvals of the oil pipelines currently in the permitting process in Texas and various other States.”

Established in the 1970s in response to the Arab oil embargo, the Strategic Petroleum Reserve is the world’s largest crude oil stash.

Located along parts of the U.S. Gulf Coast, it has been used a handful of times times since its conception: during the first Gulf War in 1991, after Hurricane Katrina hit in 2005 and following supply chain disruptions in Libya in 2011.

California State Legislature Passes Bill To Ban Renewal Of Contracts With Private Prisons After 2020 – Epoch Times

The California State Legislature passed a bill on Sept. 11 to ban renewal of contracts with for-profit private prisons inside and outside the state after Jan. 2020, including some detention centers currently run by Immigration and Customs Enforcement (ICE).

Assembly Bill 32 was authored by Rob Bonta (D) and lawmakers voted 65-11 to pass it a day after it was approved by the state Senate, reported The Hill.

The bill prohibits the Department of Corrections and Rehabilitation “on and after January 1, 2020” from renewing its contract with for-profit prisons inside and outside the state to jail state prison inmates.

It “would also prohibit, with exceptions, the operation of a private detention facility, as defined, within the state.”

It also prohibits the department from incarcerating state prison inmates under its jurisdiction, into a private, for-profit prison facility from “January 1, 2028.”…

Drones claimed by Yemen’s Houthi rebels attacked the world’s largest oil processing facility in Saudi Arabia and a major oilfield operated by Saudi Aramco early Saturday, sparking a huge fire at a processor crucial to global energy supplies.

It wasn’t clear if there were any injuries in the attacks in Buqyaq and the Khurais oil field, nor what effect it would have on oil production in the kingdom. Lightning Strike Kills 23 Cows Instantly After Bolt Hit Metal Fence They Were Standing Next To – Daily Mail

A lightning bolt has killed 23 cows after it hit one and then traveled along a metal fence the others were standing next to.

Disturbing footage shows the animals, which have scorch marks on their stomachs, lying in a row on a farm in Texas after a thunderstorm.

Rancher Bobby Woody III said it was one of the ‘wildest and craziest’ things he had ever witnessed.

‘When the lightning hit, it had such strong voltage, it basically jolted one cow in the middle of the field,’ Woody wrote on Facebook.

Bobby Woody III said he made the grim discovery on his farm outside Annona in Red River County a few days after the storm had passed.

The video shows the bloated cows’ carcasses covered in flies, some with their legs sticking up into the air. The camera then pans to show a row of bodies lined up by a fence.

A total of 15 cows and eight calves were found dead…

A state judge in Virginia ruled on Wednesday that the city of Charlottesville cannot legally move the two statues to Confederate generals that sparked mass protests.

Circuit Judge Richard Moore ruled that a Virginia state law created to protect memorials prohibits the city’s plans to remove the statues.

“Moore issued a permanent injunction preventing the statues from being moved at the beginning of a trial over a lawsuit brought against the city by groups that wanted to preserve the statues,” the Hill reported.

Democrat-Run California Has Highest Poverty Rate In The U.S. – Breitbart

Democrat-run, migrant-packed California leads the nation in poverty, according to a Census Bureau report which considers Americans’ housing costs alongside their income from wages and salaries.

The September 10 study shows 18.2 percent of California’s population is poor, far above the 13 percent poverty rate in Arkansas, 16 percent in Mississippi, and the 14.6 percent in West Virginia.

High housing costs also helped push New York’s poverty rate up to 14.1 percent, and New Jersey’s rate up to 14 percent, according to Table A5 on page 28 of the report, which is titled The Supplemental Poverty Measure: 2018.

The traditional wages-only measure of poverty shows 4.9 million Californians are poor, according to the measure. But the cash-plus-housing Supplemental Poverty Measure shows 7.1 million California live below the poverty line…

Dollar Store Manager Sets Fire To Store With Customers Inside To Cover Up Theft – Crime Online

A Dollar General store manager has been accused of setting her south Georgia store on fire – with customers inside – to hide her theft of a cash deposit of $3,300, according to the Georgia Insurance and Safety Fire Commissioner.

Kay Yvette Taylor, 41, is charged with one count of theft and one count of first-degree arson for the August 17 incident.

The fire caused more than $300,000 damage to the store’s contents and more than $399,000 damage to the store’s structure, Safety Fire Commissioner John King said in a statement. Investigation after the fire revealed a missing $3,300 cash deposit that investigators believe was the motive for the fires.

Taylor was arrested on September 11 and booked into Coffee County Jail, where she awaits trial. If she is convicted, she faces 20 years in prison and a $50,000 fine for the felony arson charge…

Charge: Illegal Alien Raped, Impregnated 12-Year-Old Girl In Wisconsin – USIACR

A Racine man accused of raping a 12-year-old girl who later gave birth was arrested Tuesday after being wanted for more than a year, according to court records. Lorenzo Bernabe-Lucas, 29, of the 600 block of 13th Street, faces a felony charge of first-degree sexual assault of a child under 13.

Bernabe-Lucas allegedly raped the then-12-year-old two or three times between May and July 2017, according to the criminal complaint. The girl gave birth to a baby last March. A DNA test reportedly found Bernabe-Lucas to be the father and a warrant was issued for his arrest two days later.

Bernabe-Lucas made an initial court appearance Thursday, during which a $50,000 cash bond was set, records show. He remained in custody at Racine County Jail on a hold order as of Wednesday afternoon, records show.

The charge of first-degree sexual assault of a child under 13 carries a maximum sentence of 60 years in prison…

Google Earth helped law enforcement discover the remains of a Florida man who went missing after he left a nightclub in 1997, police said.

Palm Beach County deputies were responding to a call from a local resident who found a vehicle submerged in a pond behind his old home while doing a Google Earth search of the area in August, WPTV reported Friday, citing investigators.

“The current resident activated his personal drone and confirmed what the previous resident saw and immediately contacted PBSO,” a news release from the Palm Beach Sheriff’s Office reads. “The vehicle’s exterior was heavily calcified and was obviously in the water for a significant amount of time,” the release continued…

Castro seemed to be the first candidate spotted standing on a booster box, as the former HUD secretary stood on the very end of the stage, near the audience, giving those who tuned in an optimum view of Castro’s debate accessories.

The employer of a married man who died while having sex on a business trip has to pay his family a large sum, a French court has ruled. The man, known only as Xavier X, was the ‘victim of a professional accident’ while working away for TSO, a French railway construction company.

Mother Busted After 10-Year-Old Daughter Filmed Her Drunk Driving, Called Police – Arizona Republic

A 10-year-old girl recorded video of her mother driving while intoxicated Saturday before calling the police, according to Maricopa County court documents.

Stephanie L. Davis, 31, of Glendale, was arrested Sept. 7 at about 4:15 p.m., near 73rd and Glendale avenues in Glendale on suspicion of aggravated DUI, records state.

The 10-year-old showed Glendale police officers the video of her mother, in which three children under the age of 15 could be heard yelling at Davis to stop before she gets into an accident, court documents show.

Officers say Davis was staggering around outside the car when they arrived to the scene to stop Davis, according to the documents. They say she admitted to drinking wine Saturday but would not say anything else.

Police at the scene said there was an extreme odor of alcohol coming from Davis and that she had bloodshot and watery eyes, a red flushed face, slurred speech and mood swings…

Median Income Hit Record High In 2018 While Poverty Declined – Washington Examiner

Median U.S. household income reached $63,200 in 2018, the highest figure on record, new data released Tuesday by the Census Bureau revealed.

The official poverty rate also reached its lowest level since at least 2001, dropping to 11.8% of Americans, or 38.1 million people who are in poverty, according to the Census Bureau measurements. The number of people in poverty in 2018 decreased by 1.4 million people from 2017 levels.

Between 2014-2018, the United States experienced the strongest four-year improvement in the official poverty rate in decades.

With the significant improvements to median income and poverty witnessed from 2015-2017, 2018 was not a particularly unusual year in terms of economic growth trends. It represents the cumulative effort of the economic recovery that started in 2009.

Iran Seizes Ship With Filipino Crew For Alleged Fuel Smuggling In Persian Gulf – Reuters

Iran’s coast guard has seized a foreign tugboat suspected of smuggling fuel in the Gulf and detained its 12 Filipino crew members, state television reported on Saturday.

It said the tugboat was carrying nearly 284,000 litres of diesel. The report did not say what national flag the vessel was flying.

Iran, which has some of the world’s cheapest fuel due to heavy state subsidies, has been fighting rampant fuel smuggling overland to neighbouring countries and by sea to Gulf Arab states. It has frequently seized boats it says are being used for smuggling fuel in the Gulf.

The incidents come at a time of tensions between Iran and the West in the Gulf that have been rising since the United States exited world powers’ 2015 nuclear deal with Tehran last year and reimposed sanctions.

While Iranian media reports say an estimated 10 million litres of fuel are smuggled per day, Tehran has been promoting legal gasoline exports through its energy bourse…

Black unemployment hit a record low in August, spurred by an uptick in employment for black women.

The unemployment rate for black workers fell from 6.0% in July to 5.5 % in August, data from the Department of Labor reveals. These number surpass the record low set in May 2018 of 5.9% for black unemployment.

U.S. Companies Add Most Jobs In Four Months, ADP Data Shows – Bloomberg

U.S. companies added the most jobs in four months in August while jobless claims stayed low last week, reports showed Thursday, suggesting the labor market remains healthy despite a slowdown in manufacturing and global weakness.

Businesses’ payrolls increased by 195,000 after a downwardly revised 142,000 gain in July, according to the ADP Research Institute. The latest data compared with the median estimate of economists for a 148,000 increase.

Hermelindo Lorenzo Guapillo-Chavaria was charged with 16 charges, including 10 counts of 1st degree child molestation, two counts of statutory sodomy, and one count each of 1st degree statutory sodomy, 1st degree statutory rape, 1st degree endangering the welfare of a child, and abuse of a child resulting in serious emotional injury.

Guapillo-Chavaria was taken to the Pettis County Jail with no bond.

Once fingerprints were obtained from Guapillo-Chavaria, it was discovered that his true identity is Alejandro Alcala-Ayala, born April 9, 1986.

The prosecutor has also filed additional charges of three counts of 1st degree child molestation, three counts of statutory sodomy and two counts of statutory rape.

President Donald Trump is reportedly moving forward with his plan to redirect billions in military funds toward wall construction at the U.S.-Mexico border.

The Trump administration is calling lawmakers whose districts will be affected, telling them a plan to divert $3.6 billion from military construction projects to the southern border wall will be executed this week, CNN reported, citing defense officials and a letter from Defense Secretary Mark Esper.

Around half of the military funding will come from construction projects within the U.S. while the other half will be taken from construction projects outside the country.

The White House reallocated a number of funds since declaring an emergency at the southern border in February.

34 Missing And Feared Dead After Scuba Diving Boat Catches Fire Off California Coast – Vice

Almost three dozen divers are missing and feared dead after a 75-foot scuba diving boat caught fire off the coast of California in the early hours of Monday morning.

Ventura County Fire Department said that it had responded to an emergency call at 3:28 a.m. PT Monday to a boat anchored just off Santa Cruz island. They arrived to find the boat engulfed in flames, tweeting a picture of the scene.

The U.S. Coast Guard said that a group of five crew members has been rescued, one with minor injuries with efforts continuing to locate the remaining passengers. Four of the crew members were brought back to shore, while the captain remains at the scene, CNN reported.

The crew was sleeping in the main cabin, while 34 passengers were sleeping below deck when the fire broke out.

The Ventura Country Fire Department initially told local TV station KTLA5 that all 34 of the passengers had died, but a spokesperson for the U.S. Coast Guard would not confirm that…

A Utah woman was arrested over the weekend, accused of identifying herself as her daughter during a traffic stop.

Gephardt Daily reported that Heather Elaine Garcia, 48, had open warrants when Davis County police pulled her over in Sunset on Saturday. Reportedly driving a BMW without a license plate, Garcia allegedly told an officer that she didn’t have her ID before providing them with her 20-year-old daughter’s name and date of birth.

“I went back to my patrol vehicle and performed a records search on the name given, [the photo] appeared to be a different individual pictured and was not the female I was with,” the arresting officer wrote in their report.

From there, a second officer arrived at the scene with a K-9. The arresting officer wrote that their search produced “broken glass that was curved with white and brown residue consistent with the shape and appearance of a broken pipe” on the vehicle’s center console…

Google To Settle FTC YouTube Investigation For Up To $200 Million – Daily Caller

Google agreed to pay $150 million to $200 million to settle an investigation by the Federal Trade Commission (FTC) over YouTube’s alleged breach of a children’s privacy law, Politico reported Friday.

The FTC voted to approve the settlement 3-2 and sent it to the Justice Department for review, a source familiar with the matter told Politico.

The investigation came after The New York Times report on June 3 that YouTube’s algorithm essentially directed videos of children in bathing suits to users who watched other videos of prepubescent kids. The FTC received complaints that because of this, YouTube was in violation of the Children’s Online Privacy Protection Act (COPPA), which prevents companies from tracking and targeting of users younger than 13.

Illegal Alien Repeatedly Raped 5-Year-Old Girl In Utah – USIACR

A wanted man is behind bars in Weber County after he was tracked down and arrested by the U.S. Marshals Service Violent Fugitive Apprehension Strike Team on Tuesday.

41-year-old Elmer Castro is accused of raping and sexually abusing a 5-year-old girl in Ogden beginning in 2008, according to a press release from the marshals service, which states the abuse lasted for approximately seven years, until 2015.

Castro is from El Salvador, and was in the U.S. illegally, the marshals service states. He was wanted by Immigration and Customs Enforcement. He was ordered deported in 2010, “but remained in the United States and on the run until his arrest,” the press release states.

A warrant for Castro’s arrest was issued on July 25 for charges of sodomy and sexual abuse of a child. Ogden police are said to have requested assistance from the marshals service to help locate Castro.

Federal authorities have yet to track down the person or people responsible for the escalating amount of deaths of wild burros in California’s Mojave Desert. But they are hoping a $58,000 reward for information may help track them down.

Forty-two wild burros have been found illegally shot dead in northeast San Bernardino county since May. Activists and donors are now doubling down in their efforts to solve the crime.

The original reward was $10,000 but, thanks to new donations from conservation and animal welfare organizations, the reward has now risen to nearly $60,000, the U.S. Bureau of Land Management (BLM) in California said Wednesday.

Pennsylvania House Ban On Nonbelievers Giving Opening Prayer Upheld By Appeals Court – Epoch Times

The ban on nonbelievers giving the opening prayer at sessions of the Pennsylvania House of Representatives does not violate the U.S. Constitution, a federal appeals court has ruled, declaring that “prayer presumes a higher power.”

The 2-1 ruling on Aug. 23 by the 3rd U.S. Circuit Court of Appeals upholds the policy of limiting prayers at the start of legislative sessions to guest chaplains who believe in God, in the divine, or a higher power, and to members of the House.

That policy – which is not limited to a particular religion – had been successfully challenged in a lower court last year, after a collection of atheists, agnostics, freethinkers, and humanists sued. That lower court ruling in August 2018 said that the restrictions violated constitutional prohibitions on making laws that establish a religion. The House appealed.

In overturning that judgment, 3rd Circuit judge Judge Thomas L. Ambro said that such a prohibition – the Establishment Clause in the First Amendment – did not apply…

Former FBI Director James Comey violated the Bureau’s policies when he instructed his friend to provide copies of memos including sensitive information to a reporter, a report from the Department of Justice’s Office of the Inspector General (OIG) has concluded.

Mexico Bar Attack Kills At Least 23 People As Country’s Murder Rate Surges – Epoch Times

At least 23 people were killed and another 13 people were injured during an attack on a bar near Coatzacoalcos along the Gulf coast on Aug. 28.

The armed assailants started a fire that ravaged the bar, killing 15 men and eight women in the process, said the Attorney General of the State of Veracruz. The bar was shot up and Molotov cocktails were tossed in the bar, the BBC also reported. Ambulances and police were seen gathering in the street following the blaze.’

The attorney general said that it “strongly condemns the unfortunate events in southern Veracruz.” The attorney general’s office will now attempt to investigate the “origin of the fire that occurred,” according to the state office.

A federal judge on Tuesday temporarily blocked a Missouri law banning abortions after eight weeks, one of the most restrictive proposals nationwide. The law, which included no exceptions for rape and incest, was signed by Gov. Mike Parson (R) in May and was set to take effect Wednesday.

Critics of the measure, such as the American Civil Liberties Union (ACLU) and Planned Parenthood, who filed the challenge, noted that many women do not know they are pregnant at eight weeks and that the law functioned as an outright abortion ban.

“The various sections specifying prohibitions on abortions at various weeks prior to viability cannot be allowed to go into effect on August 28, as scheduled,” U.S. District Judge Howard Sachs, a Carter appointee, wrote in an 11-page opinion.

An Oklahoma judge ruled Monday that Johnson & Johnson must pay $572 million to the state of Oklahoma for the company’s part in fueling the opioid crisis.

District Judge Thad Balkman called the opioid crisis an “imminent danger and menace,” ruling against Johnson & Johnson in the first trial in the United States against the company, according to CNBC. The trial began May 28, and Johnson & Johnson was the only remaining defendant.

“The state meant its burden that the defendants Janssen and Johnson & Johnson’s misleading marketing and promotion of opioids created a nuisance as defined by (the law), including a finding that those actions compromised the health and safety of thousands of Oklahomans,” Balkman said, according to CNBC. The drugmaker plans to appeal the decision.

Former President Barack Obama’s Waters of the United States (WOTUS) Rule abridged state sovereignty and constituted a federal grab of natural resources on an unprecedented scale when it was issued in 2015, but it may be no more following a federal judge’s ruling.

U.S. District Judge Lisa Godbey Wood granted a substantial victory to the 10 states that challenged the rule in the courts. Godbey claimed that the rule violated the Administrative Procedure Act and the Clean Water Act and was therefore unconstitutional.

“The court finds that both because of its combination with tributaries and the selection of over-broad geographic limits without showing a significant nexus, the adjacent waters definition in the WOTUS rule is unlawful under Justice Kennedy’s Rapanos opinion,” Wood wrote.

Wood noted that the rule was issued in direct violation of states’ rights, as the Obama administration flagrantly disregarded the constitutional balance of powers…
